I think I've read somewhere else on MSE that you should write and say that you are not accepting this as full and final settlement and that you will still pursue them for the full amount you have requested. IT'S YOUR MONEY and they have taken it from your account without your permission! It might be worth finding out if they have a fax number and faxing your letter - your local post office will have a fax service. Also, have a look at consumeractiongroup.com - which has absolutely loads of advice and help from people just like us who are trying to reclaim unfair charges. I'm sure you'll find that useful. Good luck, hullstorage - remember, IT'S YOUR MONEY and you want it back!

i am owing 3777.20 in bank charges from lloyds tsb
they have sent me letter this morning offering me 750.00
i know not to accept this but they i putting into my account within the next few days and i cannot get hold of them by phone what should i do

From what I have seen on here, you send them a letter stating that you will accept the £750 as part payment but you intend to file a claim for the remaining amount. (if they put it straight in your account this will come in handy when you have to pay to file your claim)
There is probably a template letter for this on here somewhere as it seems to happen quite alot with Ltsb.

    Hope this helps

make sure you state in writing that you accept this as PART PAYMENT for the £xxx amount you are owing and that £xxx is still outstanding and if that you will be prodceeding with court if you do not have the full amount back within x amount of days (i would give them just a few days) and then file with the courts

this is typical LLoyds - i have claim of 2607 plus interest and they have until 10th to pay up or its court for them and im half expecting £750 to be paid into account

where they'll win is with people who dont know about this web site and how LLoyds operate - so they'll score with most people.

keep the faith you will get it all back!! everybody elses does - dont let them beat you

    good luck
  • hello,

well done all those who paved the way in actions against the banks re: charges. seeing the history, I thought I would try to reclaim my single charge for £30; the bank would not "goodwill" charge back and so...

LloydsTSB sent the standard letter justifying their charging, ignored me when I offered to go to court, but now, the bank have decided to defend the entire fee according to their solicitor's response to the court...

    is this their standard response?

I am curious - so far Martin has said no bank has gone to court due to not wanting a test case - has anyone else had this situation with their bank?

    many thanks,

I've got as far as getting the statements off Yorkshire Bank but these seem to be the hardest of them all with which to claim money off.
I've not even bothered to work out how to work out how much they owe me as I dare not face the courts so I've fed them into the shredder.

I hope and wish you all well though in your claims and hope you have more guts than I do

Oh Dave what a pity. Request them again. You won't actually have to go to court, you file online, the bank wont show up and you win by default.

as expected got standard letter from LLoyds TSB - saying thanks for getting in touch but no thanks etc etc

I gave them until 9th april before i advised them i'd be taking them to court if the full amount was NOT refunded - since they have sent a letter saying "no way" can i assume i can file with the court immediatley?

LLoyds obviously think WE are stupid!!
