Hello, I've made a bit of a mess of my bank charges claim. Because I got distracted by a few life matters, I failed to take Lloyds tsb to court when they turned me down about 6 months ago. Now I want to get on with it, but the amount is different because 1- some charges now too old, 2- lots more charges over last 6 months and 3- have realised you can add interest. Should I just go ahead with the new amount (more) or do I have to go through the letters to bank stages again? Any ideas ? xxx

I've waited and waited to file with MCOL against Yorkshire Bank as I've been a bit scared (weak I know but there you go) but keep receiving letters from them delaying everything so I've taken the plunge. I'm claiming £4,400 plus interest. So if i've filed today 2/4/7 then their 28 days should be 30/4/7 shouldn't it plus a couple of days for the MCOL filing delay?

we sent the first letter two weeks ago and received one back saying 'we're looking into it . . . blah blah . . . we'll be in touch within four weeks'. Should I go ahead and send the second letter or take them at their word and wait?

    Thanks,

    Clare

CYNtheSys is a computerised system that Yorkshire have apparently utilised for costing individual transgressions of accounts. It was exposed on the Whistle Blower programme.

I have asked for disclosure of it on my Draft Order for Directions.

I have a claim filed through the courts with Lloyds TSB. I am at the stage where it has been served but Lloyds have until the 9th April to acknowledge/defend.

I have just checked my online personal a/c (a/c I am claiming for) to find a payment of £582.02 has been credited with the description of F/FLOW/********** ( * thus representing 10 numbers) it's also a transfer as if it's internal. Bearing in mind I am claiming a total of £1,700.

Normally I can check my statement history, however all of a sudden since this payment has been made i can't check further than 1 statement. It comes up with an error message 139148 - There are no further statement sheets available online.
If you require any more information please contact your branch.

Now my joint a/c is linked to the same online screen and as I am not claiming for any charges on there, I can still check previous statements and all seems fine and dandy. So it can't be a system problem.

Do you think this is a partial payment from Lloyds as I can't think it will be anything else?

I have read normally the standard goodwill is around £750 if claiming over a £1000.

    Can anyone advise?

    Thanks

    Taff ;)

    Clarenic,

Stick to your timescales, this is just another delay ploy.. Send the next letter or file a claim through the courts.

have my claim in with tSB - they have until 9th april before i apply to the court. No acknowledgement of letter even though i hand delivered it as yet

Can i ask because we put in the letter they have 14day- do we have to stand by this? Seems as thought TSB always go to the court stage on claims of 1grand or more and mine is 2307+ interest.

Also seems like they dont acknowledge most peoples letters anyway so would they be any the wiser they have until 9th?!????!?

as you can imagine im eager to get them lol - and know its gonna go to courst stage without he full amount offered

is it also worth ringing up manager of tsb who the letter was addressed to saying ive had nothing back as yet?

any advice would as always be gratefully received folks

    Missc,

My advice would be to wait a few days after the 9th April due to the bank holidays. The court would look favourably on you if you did this, however it's your call. If no satisfactory response is received then skip the next letter and file court action. The reason I say is I have never heard of Lloyds settling out of court for the amount of money your claiming and cuts down time.

I sent my 1st letter giving them 14 days to reply on the 5th Feb and they replied on the 14th Feb saying these charges are fair so pi$$ off!

I then sent my LBA (Letter befor court action) on the 21st Feb giving them 7 days to respond otherwise were going to court. No reply.

Due to having no cash I had to wait until the 21st March to file via MCOL at a cost of £120.00.

The rest of the story can be found about 3 or 4 posts above.

    Good luck

    Taff ;)

  • Advice reqd. Bank with Yorkshire Bank. Have received 6 years worth of statements. When I was in debt , up to a couple of years ago, statements show, after going over my £1800 overdraft, £5 per day unauthorized O/D fee, £25 "charges" (possibly for a letter ?) and then debit interest, usually around £20-£25. Having read Martins article, which bit do I claim back and which are "legal". Anyone experience of this bank ?

Quote from my latest letter from LloydsTSB

'The office of fair trading has published new guidlines on credit card default charges. We're still talking it through with them, but the important point is that the guidlines are about 'default' charges that people pay when they break an agreement with us. This doesn't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you havent broken your agreement. They are our prices for the service we provide in these situations.

Has anyone had the same letter? is it a new one? I've already started my MCOL, but this question of when is a fee or charge a penalty or a service charge and does it make any difference? is worrying.

I think i'll just go ahead with the claim anyway...

My friend had the same letter, does she still carry on?
thanks in advance for any help you can offer......
