    Hi there - my hubby has an account with Yorkshire and we are going to try and claim back for the charges. I havent really read any success stories about that bank.. Can i ask how you started the ball rolling - cos i dont have a clue where to start!! Thanks

    I first contacted Barclays at the end of January this year asking for statements going back just 2 years before I left them in Dec 2003. I received an acknowledgment 2 days later then nothing. When the 40 days were up I wrote to them again giving them 7 more days or I would report them to the Information Commisioner.

    On Friday I recieved a letter from Barclays saying they could not trace my account, even though I had supplied them with date of birth and my address which I lived at for 7 years before I left them!

    I'm not too sure what I do now, is it worth me going through the Financial Ombudsman route?

    have my claim in with tSB - they have until 9th april before i apply to the court. No acknowledgement of letter even though i hand delivered it as yet

    Can i ask because we put in the letter they have 14day- do we have to stand by this? Seems as thought TSB always go to the court stage on claims of 1grand or more and mine is 2307+ interest.

    Also seems like they dont acknowledge most peoples letters anyway so would they be any the wiser they have until 9th?!????!?

    as you can imagine im eager to get them lol - and know its gonna go to courst stage without he full amount offered

    is it also worth ringing up manager of tsb who the letter was addressed to saying ive had nothing back as yet?

    any advice would as always be gratefully received folks

    Just wait until the 9 days are up - have all the forms ready to go and hand deliver them to court.

    Where are you taking your deemed date to be served from please? My claim was issued on 28.02.07, the court said it would be deemed to be served on 05.03.07, YB acknowledgment of service was dated 01.03.07, I received their defence yesterday. Don't be surprised if their defence turns up on Monday. If you are sure of your dates the MCOL site takes you onto judgment but I would double check Martins faq and also the consumer action group.

    Read all you can on this site and also on the consumer action group site where there is a forum for each bank. There have been success stories but YB are a hard nut to crack and seem to take it to the last minute before settling.

    Hi Thanks for response, My claim was deemed served on the the 5th March also, Should YB defend, will the court let me know straight away on the Moneyclaim site? I dont mind if they play hard ball... Im the most stubburn assed guy they will ever meet... I will see them in court if that is whats required of me!!
    Stick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.

    Go check the faq but I also read somewhere that if they acknowledge service they have and extra 14 days to file their defence. Was going to check this out but then I got their letter yesterday. They definitely play hard ball. I did read somewhere else, to send the allocation questions papers back asap as this tells them you mean business.

    hi all i have asked afew questions on here but dont seem to get answers i sent my first leeter using the template of here i allso eclosed the £10.00 fee which they can charge to send your statements isent sent it to the addy at the top of my bank statements i had last month (customer service centre dept 08-01 box 2 bx1 1lt is this write i sent it on the 9th of march so does that give them roughly till 11th or 12th of april to send my last 6 years of statements and if i dont hear anything from them what do i do then would be very gratefull for some help.....ps they have just hit my account for £60 pound it says charges for period 3rd feb to 2nd march 2007 0/draft excess fee can i claim this back to.........

    14 days extra...Why not just give them 42 days from the start then! I will see if anything occurs tomorrow and will ask for judgment by default anyway and see what happens....Also if the bank do decide to play it tough am I entitled to claim any Solicitors fees should I need to go to court (regardless of wether they show or not). Dont want to show up in court without legal council as I have to assume they will bring the big guns, also this could be used to apply a little leverage to help them to settle earlier. What do you reckon??
