    Slippyhelen, Lloyds are notorious for this - they seem to want to be dragged kicking and screaming before they'll do anything. I am dealing with them right now and they appear to be run by monkeys - they cannot compose a decent letter, they don't know who is dealing with what, they cannot spell my surname right and nor, for that matter, can their solicitor. They replied incompetently to my first letter and have completely ignored my second one so I have started my MCOL. Lloyds have said they will defend the claim and I received a mildly threatening letter from their solicitor yesterday giving me seven days to comply with all their demands or they will apply to get the claim struck out. I cannot get all the info they want within seven days but I have sought advice and have been told that I can respond to them by saying that seven days is unreasonable and that if they make the threatened application I shall seek an order for costs against LloydsTSB. I can also tell them how long I need to be able to comply. I am only telling you this because I think you have no choice but to go to MCOL asap to get the ball rolling. I have not heard of anyone being refunded their money from Lloyds without them having to threaten them with court action. Take heart from the fact that not one bank - not even LloydsTSB - has yet to let the matter get as far as a court hearing. They just love to put the frighteners on to try and put you off; they probably succeed in a lot of cases where people feel so intimidated and worried that they give up. I am determined to see this through to the bitter end. It is MY money, not theirs and I want it back! I wish you good luck and don't let the b******'s grind you down!

    gdarren - many thanks for your reply. I have sought advice this morning and been told that I can write to the solicitor saying that I consider the seven day period is unreasonable in view of the details required but that I can let them have the info within 28 days (which I should be able to) and that, if they make the threatened application to the court I shall seek an order for costs against their client. This may help others who post in with similar queries - it gives you more confidence to be able to use the right terminology when dealing with these people. Many thanks - I'm not sure if you are trying to get money back from someone but, if you are, good luck!

    Hi EIenia, i recieved a letter from the bank this morning ( there 28 days was up on the 4th April so they leave it till the last minute to file there defence) sayin they have sent there defence to the court it is a five page letter stating all the terms and conditions of the bank and the charges then goes on to say that the bank feels that there charges are inline with the costs incured when an unauthorised overdraft is made blah blah blah, basically they are saying i am not entitled to any compensation or a refund because i didnt comply with the terms and conditions of the bank. I am expecting to get a court date shortly now there defence is in. Keep me posted on your progress. good luck

    Hi tricia, I think that the yorkshire bank maybe do train there staff to be sly and underhanded, my mother in law paid a bill at the yorkshire bank it was for something like ten pounds and 20 pence, the company who she had paid the bill to, contacted her and said she had only paid the ten pound and owed 20 pence and that they had charged her 15 pound for not paying in full, she went into the bank with the reciept showing she had paid the full amount, the bank admited that they had made a clerical error and only processed the ten pounds ( god knows how this had happened cos i thought it did it automatically when they scan your bill and enter the amount in to there computer) she asked them if they would pay the 15 pound charge that she had incured with the company they refused to pay this charge even though it was there fault she had been charged, she closed all her accounts with
    the yorkshire and moved elsewhere, since closing her accounts she has had 2 phone calls apparently from the yorkshire bank asking her go and see the manager urgently as there is a problem with her accounts and they can not be closed properly, on both occasions when she has got there no one seems to know anything about the phone call or the problem with the accounts and said she must have had prank calls, so basically she has wasted her time and petrol. Who would prank call her about this only family members knew about what had happened. makes you wonder if it is yorkshire bank staff playing games??

  • hi there ihave two current acc with yorkshie bloody rip off bank and have sent my £10 cheque (which was cashed straight away) and having to wait the 40 days. i had my statements for the other account already so sent first letter requesting charges plus int recieved terms and conditions leaflet nd letter basically telling me i had no right. i sent my second letter saying id take them to court and to reply within 14 days. i got a reply in 14 days saying they had opened the case again and hopefully would come to a satasfactary conclusion and would be in touch SHORTLY. nothing for 10 days so i tel leeds charges office and spoke to the manager. he told me basically nothing other than my letter was in a PILE and would be dealt with in the specified time outlined in terms and conditions of 56 days? he was stroppy and arogant. do you wait the 56 days at this stage or take straight to court. should i also wait to recieve my statements for other acc and if no success take both to court at the same time or just go ahead now?thanks

    I did a letter to them giving 7 days, but left it two weeks. Got letter this morning stating that the charges applied are not default charges for breaking an agreement but administration charges.

    Gone to money claim online this morning...

    I rang them up today (0121 6335476) and chased them up (sent the 2nd letter to them requesting these statements on the 19th march)
    woman straight away without asking any details said - they'll be out in 5 days?!?!?
    asked her how she knew this without taking any of my details - she said cause we've brought in extra staff to sort this out. I then said if this is the case i posted my letter 19th - you rec the 20th so thats 10 days so could i give her the details - she said they are not taking details or dealing with seperate accounts.
    I then thought "turn on the charm rather than get angry" so said to her "bet your sick of your life with all the calls etc" and was very friendly - she then said "i tell you what give me your account details and i'll pull them out seperatly and print them 1st class in the morning for you"
    so id recommend people to try the nice nice approach - seems to work - probably cause they are just taking calls all day off angry people ( was worth holding the anger in lol)

    Has anyone had the same letter? is it a new one? I've already started my MCOL, but this question of when is a fee or charge a penalty or a service charge and does it make any difference? is worrying.

    I think i'll just go ahead with the claim anyway...
  • Got my letter through after a long 30+ day wit and as requested i got all my charges listed for the last 5 years, It says " i may now wish to proceed with the claim of reinbursement of charges "

    Where do i send the 2nd letter with my request to get the moneys owed ?
