  • For many years (including my student days) i banked with Lloyds TSB. Being a student meant that on a number of occasions i went over my overdraft limit, and got hit with the usual £30 a letter charge.

    I was wondering if there is any way of claiming those charges back, the only problem is i no longer have all the bank statements.

    Can anyone advise??

    sorry you havent had replies before - its so busy on here at the moment that somtimes peoples posts get shunted down the line really quickly - you can "bump" them up if you don't get anyone replying.

    Anyway, onto your claim. You have to give the bank 40 days to respond with your statements. If it is your normal account the statement for 5 years are on-line. You can print them out yourselves and don't have to wait.

    They will send them to you in the time limit (ours took 35 days!). Once you do have them, put all the charges in Martin's calculator (on the Reclaim your charges info page), including the interest if you like (and why not?) and print that out. Send that with the downloadable letter and make sure you keep a copy of everything you send.

    I have a set of files now specifically for reclaiming from each bank/ credit card/ loan company. On the fornt of each file keep a list of dates that you have done everything. eg. date letter sent, date reply received,, etc.:money:
    Our claim with LLoyds TSB is nearly £8000 :eek: with interest and we are due to file with MCOL tomorrow.

    Definitely include the most recent charges too.

    Yes, within the last six years, it's fairly straightforward. Please read the Step by step guide in my signature.
  • I sent off the first letter (using the template from this site) for details of the bank charges under the data protection rules.

    But a few days ago (just before the 40 days was up) i got a letter saying they will get back in touch with me again in 4 weeks.

    What do I do now?

    It all works out good in the end.

    its 28 days from service to defend - regardless of when they acknowledge - if that helps.

    be careful with Yorkshire bank they are not the easiest.

    BUT we have a lovely little matter of their costings system to whack them in the nuts with :D have a look on the Consumer action group homepage - include a request for disclosure of cynthesys in your AQ ....

    you dont need a solicitor. so no fees.

    they wont show in court but they will try every trick in the book to get you to settle for less....so don't.

    look on CAG - their Yorkshire bank forum is excellent at the moment.

    DPA is 40 days, no more...you need to write to them telling them you are reporting them to the ICO and willl consider court action to make them comply if they dont get the info to you within 7 days.

    Make sure you count your days correctly..........MCOL allow several days from the beginning of the claim for the documents to be served.

    So if you started your claim on 1st March, it won't be 29th March that their time is up, it'll be several days after.

    It's common practice to issue the Defence on the last possible day.
