    Has anyone got/been to this stage? I am just wondering how long it takes before a Court date is issued. Watching Corrie last night in the Court House gave me the shivers! lol

    It's really annoying that Lloyds are putting people through this 'defence' stage as from what I've read on here it looks like they have no intention of actually going to court - unless we're going to be the first!!!!

    6 March 2007 - Lloyds filed their defence and court sent me AQ
    8 March 2007 - Filled in and sent AQ - Last date for filing with court 23.03.07
    27 March 2007 - Nothing heard back yet!

  • Sent letter to Lloyds in Novemeber, after taking weeks got the generic fobbing off letter they seem to send everybody. Sent letter stating intention of legal action, no reply... Issued online court claim for circa £5300 + interest on 2/3/7, they stated intention to defend on 13/3/7...
    Today my online court progress report tells me:

    Defence

    You are unable to take any further action online on this claim.

    The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.

    Is this the !!!!!!!s just playing for time again? I have heard absolutely nothing back from Lloyds at all, no offer of token payment, nowt and they are still stinging me with these crippling charges.
    Does anybody know what will happen from hereon?? Obviously I have all my statements (i.e. proof of these charges)
  • sent 1st template letter asking for statments to Lloyds tsb 2nd feb.
    After hear about possible OFT ruling in March decided to claim only last 4 years which was available for me to view on line (£1007.)
    so, without waiting for response to letter 1 went straight to letter 2,sent
    24th feb.
    Got most patronising,'pat-on-the-head' letter on satutday 24th, "our charges are correct, you new what they were, now toddle off little boy and get an education you moron and don't waste any more of our time".
    so sent 3rd letter threatening court action by registerd post yesterday 26th march.
    seems to me, looking at some of the posts on here, that lloyds have the more transalvanian roots than all the other banks put together, everyone appaears to have the most agro with these, persevere is the watch word so lloyds,lets go all the way..BRING IT ON BABY.. keep you posted.
  • After going round the houses with Lloyds i found out the following. They have been sending out a standard letter going back to September 2001 to stall the process (they did admit that to me!). If you call 0121 633 5476 and speak to the copy statement department, be nice as pie and very understanding and jokey with the ladies there and they will post the missing statements straight out to you without you having to re-apply. This is obviously if you have received an incomplete request.

    I am going to be starting a Debt Management Plan with Payplan in April. One of my creditors is Lloyds, who I owe £18K to. Up until recently my current account was with Lloyds but I have now changed. I am thinking of reclaiming my bank charges but I have to tread with caution. If I try to reclaim hundreds of pounds from them, won't they in turn refuse to freeze interest and reject my DMP? Has anyone been in this situation - please advise?????

    Hi,
    I used the address given in the other thread with the addresses and it took forever to get a response. Myt letter wasn't even signed for as I'd sent it recorded delivery. The address on the letter responding to my request for statements was:

    Lloyds TSB Bank Plc,
    Copy Statement Unit,
    Swallow House,
    PO Box 139,
    10 Swallow Street,
    Birmingham.
    BX1 1LT

This does not apply to your Charges as these were for dealing with your request to go over your agreed overdraft limit. Theny are not default charges because you have not broken your agreement. They are our prices for the service we provide in these situations.
    I understand that you may also have some concerns about us sharing your information with credit reference agencies we use, I'd like to re-assure you that this does not apply to bank charges, only white data payments to credit card, loan or mortgage acs.
    I do hope that you can see that we make our charging as fair as possible and why I cannot agree to cancel your charges.
    Referred me to Ombudman etc.,

    I EXPECTED THIS RESPOONSE FROM LLOYDS AND WONDERED IF THERE IS ANYONE MORE IN THE KNOW THAN ME WHO CAN HELP ME TO CONSTRUCT A LETTER BACK...ARE THEY RIGHT? I COULD GIVE UP

    I got practically the same letter from LTSB. My first letter they ignored and I only received this after threatening court action.

    As I'm not going to get anywhere with them and I assume this is to try and fob people off, I guess I just proceed to MCOL?

    I've just got this same letter...

    What shall i do now go to MCOL. Or leave it for a week?:confused:

    I found your post interesting, especially the way they sent you a letter which didn't have a stamp on. Last week I received my bank statement from Yorkshire bank which had beenopened prior to me getting it, and someone had written on the envelope 'posted to wrong address try again.'
    The last time this happened with my bank statement was again when I had complained to Yorkshire about the way they handled my account last year.

    One wonders if they are now employing people to be deliberately provocative?

    My local postie is quite well trained,is even friends with the dog, and he can't understand how it happened, as he takes extra care with my mail.
    Be interesting to learn if anyone else has been on the receiving end of such meddling with the post?

    Keep going I have registered with MCOL now, like you i feel bring it on............thousands are getting charges bak why not you and me !
