Standard procedure from Lloyds depositing a goodwill gesture. Write to the bank and say you will accept this in partial payment and without prejudice but your claim will be continuing. They will offer the remainder before it goes much further.0

Hi, I am looking into asking for the charges back from my local LTSB. As a branch they have always been extremely helpful in lending money, extending overdrafts and extending our mortgage. Obviously we get charges for going over the overdraft etc. which really annoys me when on occasion i have only been 56p over the overdraft and charged £30. If I go ahead and ask for bank statements etc am I going to have problems with my account usage? Are they no longer going to allow a cheque to go through if it takes me over my limit?
I am so unsure what to do. I dont want to rock the boat as it were.
Any advice please !!!!!!!!!!!0 -
Hi KatieR, how long have you been on to Lloyds for this?
I have put in a claim from them, did you include interest?
Cheers.0 -
I recently asked Lloydstsb for my money back and they gave me some back as a goodwill gesture, but at the same time they sent me the goodwill gesture i started court procedings to claim it back.. so basically what i would like to know is i have half the money in my acconut from them and am going through court for the total amount, should i just leave that money alone until all is settled or would it be ok to draw out what is in there?0

By banking the cheque it kind of looks like you've accepted the offer. Did you send them a letter saying that you'd accept it as part payment before you banked it?0
-
The letter said that the money would go straight into my account so i rang them and said that i didnt want to accept this that i wanted the full amount and they said it had already gone into my account and that if i wanted the rest that i would have to go through the courts.0

Write something like this to the bank:
I cannot accept your offer of £xxx as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance. I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I will now settle only for the full amount of charges+statutory interest+court fee.
You also need to inform the court that part of the claim has been paid, and amend the amount you are now claiming for.
After that I can't see any harm in you using the money.Reclaimed thanks to this site:

To add to what Beate has said this is a standard procedure by Lloyds and the amount depends on how much your claim is.0

My claim is for £3260.37 that is including interest and court costs, and they have given me back £1125.00 as a goodwill gesture.0

Can any one help please. I recieved a letter from Lloyds TSB stating that they are very sorry to hear that I have made a complaint, if I do not answer thier letter within 14 days they will assume that I am happy. I;m not, they have since closed my account and I still have not had 6 years of bank statements from them as asked in my letter to them a month ago, I paid my £10.00 for them to send me my statements. What do I do now, there is not a letter that I can download asking what has happened to my statements etc. I am so confused and outraged that they close my account without even going any further with me.
look forward to your help
