    HELP NICKMAC PLEASE

    Today I got another letter from the online claim court saying that Clydsdale Bank (not Yorkshire now apparently) are contesting all of my claim and that Kirstie Ann Ross, solicitor of Glasgow, is the one intending to do so within 28 days. Perhaps English solicitors aren't good enough?
    Am I expected to attend court when she defends, or is all of this done in Cyberspace?
    I have all statements with charges clearly listed, do I just go along to court with these and contest or something?
    Can you give me a link to people who have got to this contested claim stage PLEASE? WOULD REALLY APPRECIATE IT THANKS
  • Hi , I have just received letter from Lloyds this morning saying they are soory to see i am unhappy with my account charges etc! etc!. they will investigate although it may take a while but aim to complete their enquiries within the next 2 weeks. Are they stalling or shall i wait for the 2 weeks or longer. my letter was sent on the 12th Mar requesting my charges back. there letter was dated 20th mar.
    Anyone had the same letter ?
    And any ideas as to what I should do now?

    After 3 months in dispute with Lloyds TSB, yesterday I received the AQ from court. This morning I have just received a letter from the solicitors of Lloyds saying that they are going to pay back ALL of the monies owed (over 5 grand!!).
    I just cannot believe it. I want to thank all the people who gave me advice and more importantly encouragement to carry on. I must admit I wasn't pleased to be taking it to court, but it has been worth it. After all, it was my money in the first place, so if you are planning to take your bank to court and you are having second thoughts, just do it. As Martin says there is never any guarantee's but boy it is worth it in the end. Last of all (sounds a bit like the Oscars) I want to say a BIG THANK YOU to Martin, who without his words of wisdom I would never have thought of doing it. Regards to you all:T :rotfl:
  • HI all, need I think some reassurance or help here.
    I have started my claim, received court documents and I am still being charged by my bank at the rate of £8.00 per day; I rang up the court today regarding this and I was told I can ask for the judge to consider this by using an N244 form claim.

    Coincidentally, today I received an acknowledgement from the court that the Yorkshire bank as defendant has ‘responded to the claim and indicates an intention to defend the entire claim’. This acknowledgement was filed the Yorkshire banks solicitors; is this just scare tactics or do I have to be even more on guard; I am getting more and more nervous about it yet I still feel that we all have been bludgeoned by these charges over the years.

    Any comments will be greatly appreciated; thanks

    Ive decided to use the ombudsman service to claim the charges back on all three of our accounts. It does'nt take any longer than six weeks. Anyone else done it this way and found it quicker than doing it youself ? if so post your experiences, thanks
  • Hi folks, well done to Mal1, it's reassuring to hear of more success's. I've recently joined this forum and am in the process of reclaiming charges. I have gave the bank 14 day's as per letter template,( but never sure if 14 working day's so have given them the benefit of the doubt). Haven't heard a thing, have checked with LLoyds that I've sent it to the right address. They gave me Customer Service Recovery Centre, 125 Colmore Row, Birmingham, B3 3SSF as the address.

    So i'm sending the next letter stating i'm going to make a court claim if i don't hear from them in 7 day's( working day's?).

    After this i understand i have a choice of writing again saying i am prepared to negotiate the charges or complete a claim form on line.

    I think i understand what i'm doing but if you know better please let me know.


    Non essential spending for this week, £3.53.
    Essential spends, Petrol £10, gas £8, electricity £8, grocery's(last sunday so don't count for this week).

    Plus £11 guitar lesson for my teenager, an essential spend believe me! there's nothing worse than a badly played guitar.

    Thistle 26, don't worry I did the same then heard nothing so sent a reminder to the branch, 3 days later I got a reply from the regional office in Birmingham confirming that my statements were on their way. Now I have half a rain forest to sort through!

    I know how you feel and if you read my post you would have seen I am at the same stage too, except at the moment I am also reeling from gratuitous shock tactics being used by other gov agencies at the moment, making my situation radically worse on top.
    My take is this, the bank gets usurious interest benefits from any overdrafts it charges interest rates on, therefore to pretend it can legitimately charge again on top, is double charging me for things which are often not my fault. Most of my charges are a direct result of questionable corporate practice such as an employer promising money owed would go into my account, then it didn't till three months later. Or the utilities continued taking more money from my account than agreed, or that they were owed, so driving me into overdraft.
    In addition, we are all forced into using banks for everday transactions and for the banks to hold us over the barrel and adopt a stand and deliver attitude, regardless of whether the money they demand is honestly what it costs them, and we know it isn't, is akin to highway robbery and Martin is helping us take the robbers to court to get justice. It is the banks who should be ashamed and scared. Also I can't wait for them to reveal the true cost to themselves, which is what they will have to disclose in court.
  • Received my acknowledgement of service from Yorkshire Bank (or clydesdale bank) as they have some solicitor in Scotland for some odd reason? they are defending the claim, cannot understand how all the banks are backing down and YB as far as i can see are defending all claims against them... has anyone actually had a good outcome from their dealings with YB - i have a feeling this is going to go all the way and ill be the one losing out - any replies would be grateful

    I am claiming back £1483 from LLoyds through MCOL who have entered a defence disputing the whole amount. Meanwhile, £750 has appeared in my bank account under 'EX-GRATIA payment', with absolutely no explanation. I've called them several times, but haven't managed to get them to confirm that it is to do with my claim. What should I do? I'm worried that if I spend the money they will suddenly ask for it back, but if it is an offer in partial settlement, shouldn't they have written to me to explain this??
