  • Thankyou very much, I will await the statements. I know what they are trying to do, they are trying to confuse me out of claiming!!
  • I wrote to lloyds to claim back 700.00 in bank charges, they wrote back stating that they are not default charges, but prices that they charge for providing a service in those situations where you go overdrawn.

    I have now a second letter demanding the full amount including interest and if i dont hear anything within 10 days, i will issue court proceedings.

    I just hope it works with Lloyds as they seem to be the difficult ones from all the banks, its worked with RBS, have a look at my response in the main section.
  • I sent my 2nd Letter to Lloyds 2 weeks ago, I have had no response. I did not send this by recorded delivery so im worried that if I go ahead with the online claim they will come back and say they did not receive a 2nd letter. Should I resend this letter recorded delivery, or maybe phone them to see if they received it, or should I go ahead with the online claim.

    Hi

    Hope someone can help. I sent my first letter asking for my £600 odd back. They sent me a letter back basically saying no. I then sent them the next letter giving them 7 days to respond. Its now been over 2 weeks and they havent responded. Do I have a time limit as to when I can set up a claim on MCOL as I dont have the money to pay for the claim until the beginning of April and I dont want to risk loosing out of getting my money back.

    Am new to this and im still in the first stages.
    With online banking i was able to go back to Feb 2002 and those charges amounted to a staggering £4684, so i decided that i would like to go back the full six years and get back as much as i can
    Sent off request with £10 cheque (this was cashed) on 12th Feb 2007. knowing that it was coming up to the 40 day deadline i thought i would give them a call and hurry things along, but was told that they actually have 8 weeks to supply this information ( 40 working days!! is this true? )

    But to my surprise on saturday 17th March i recieved a call from thier collections department to tell me that i was overdrawn again, i said yes and that it would be put right on friday when i get paid but my account would be back in the red by the time they put on this months charges (£120) on the 10th April, He said that as a good will gesture they would waive the fees for this month. Whats that all about?

    Have been telling everyone I know about this site and am also claiming £750 from the Halifax for a friend.

    If anyone could shed some light on any of this that would be great.

    I am trying to claim back £105 from Lloyds TSB for 3 unpaid DDs (at £35.00 per time even though the DDs themselves were each for less than £20 and in each case would have only taken me between £3 and £7 over my overdraft).

    The letter I have received says that the charges are justified as they are 'not default charges' because 'there has been no breach of contract' on my part. The letter goes on to say that these charges are 'service fees' for actioning my requests to go over my overdraft limit.

    I disagree. Going over my overdraft limit is clearly a breach of the agreement I have with the bank and therefore the charges are default charges (and not service fees). And for a service fee to be justified then surely some form of service has to be provided? In each case the DDs went unpaid so I fail to see how a service charge is justified.

    Can anyone help with what to do next?

    This is a standard letter from Lloyds and you should just carry on with your next step.

    Quick Question - I am sure this has been covered but I sent a letter to my branch. I have now read it properly and see that it should be the Lloyds centre. Should I just send off another letter to the centre?

    Any advice appreciated.
