  • I'm about to help my daughter claim back approximately £2500 from Lloyds TSB. As we live in Scotland and the maximum small claim up here is 5years and £750, how do we go about claiming this larger amount?

All help greatly appreciated, thanks in anticipation.;)

Start your claim for the full amount but have a read of this thread incase you actually get to the court stage.

Hi all, Have just seen that LLoyds heve acknowlaged the court papers and have until 7th of April to defend case.

Any ideas what to do now apart from reading up and preparing to fill court questionaire in if or when it arrives?

Also for the record, been with Lloyds for 21 years and asked for a loan, was offered 13.9% and after complaining about it they dropped it to 11.9%, so looked around and got loan from alliance and leicester at 6.3%.

Shop around, it pays , and stick to your guns.

They never responded to me after the third letter was sent and have heard nothing since the standard "were not paying up " reply to second letter.

    Hi Everyone,

I've got a quick question. Up until late last year October/November we were getting hammered with bank charges by Lloyds/TSB. On average we were looking at £60-£100 a month and on our worst month last year we had over £250 in charges, due to erratic pay dates and the inflexibility of Direct Debits. However October last year we were called into the bank where upon we were offered a Budget Account with an overdraft facility to cover Direct Debit payments and a car loan (previously we'd been refused a car loan and had to hit a sub-prime lender and when I'd enquired about a budget account six years ago I was told they didn't do them any more).

Anyway I'm not worried about our overdraft facility...we've got less than £300 owing at the worst, however if we start proceedings to reclaim charges can they play silly games over the loan?

If they suddenly decided they wanted the full amount back we'd be sunk,

    Many thanks,

    Phil

I'm in a very similar situation Phil. I'm currently paying off a refinance loan with LloydsTSB and am a bit concerned that they could demand instant settlement of that loan if I followed through with my claim for charges. I questioned this on this forum a short while ago but nobody was able to answer me definitively. The way I look at it though (with my limited knowledge) is that my loan is regulated under a different agreement from my current account - they should only be able to ask for instant settlement if I had not kept to my side of the agreement i.e. made late payments - which I haven't. I musts stress that this is just my interpretation of things without have definite guidance.

I sent the 1st letter about 3 weeks ago and have still heard nothing back.
Made a phone call to them this morning and was told that, due to the sudden influx of these claims, they have had to set up a new office in Birmingham and all claims have been forwarded there. They are currently 4-6 weeks behind.

I have just received a reply from the Lloyds Customer Recovery Service about MY COMPLAINT this was in response to my letter requesting repayment of bank charges . The letter was addressed to both my husband and myself, this claim is for myself only, my husband has never banked with Lloyds or Lloyds TSB , I thought the Data protection act forbade this !

The letter claimed they hope to have ther enquiries completed in 2 weeks, but should there be a delay they will let me know.

Should I now take the next step ?

Have tried phoning the Customer service recovery in Andover, 3 hours later and the line is still engaged, it did ring once for about 20 minutes with no reply.

Have been trying to call them myself this morning as I haven't had a reply to my first letter after 3 weeks. I got given the Andover nymber 01264 832297 and after ringing to engaged once I just knew it was going to be one of those phone left off the hook jobs. Rang this other number and they were able to help straight away - no menus, it gets answered by a person:

    0207 6261500.

Hope this is of some use!

PhilB, I've had another scour round the forum and found this regarding your worries about the loan:

    http://forums.moneysavingexpert.com/showthread.html?t=360574

It looks like I had a lucky guess and the bank will have no right to demand instant repayment on the loan.

    Good luck!
