  • sent off my court papers yesterday bring it on YB have got away with it for too long - report them to the financial ombudsmen i have and they are looking into it!
  • This is the very twee letter I received from them.
    Dear xxx
    I am sorry you are unhappy about your ac charges.
    Like any business we do make a charge for some of our xtra services. When customers don't have enough in their acc's to cover a payment, this always means extra work, and has to happen quickly. We have to agree to make the payment by setting up or increasing an overdraft, or tell customers we cannot agree it.
    Of course it is only fair too, that we are completely open about any charged for services before you might need them. Thats why we take care to give every new customer the latest guide to our charges (I've been with LLOYDS for the best part of 20 years and never received any such thing!)You can also get up to date details about fees and borrowing rates at all our branches, through our helpline and on our website.
    Just as importantly we do everything we can to help our customers avoid these charges. You can get an up to date balance enquiry at any of our cash machines,,over the phone, on line or by text.
    If you know a payment is going to take you over your agreed limit you are welcome to see if there is anything we can do....(yeah right - offer me a loan at extortionate rates!)
    The OFT has published new guidelines on credit card default charges ???(very odd I never asked about these?)We're still talking it through with them, but the important point is that the guidelines are about "default" charges that people pay when they break an agreement with us. This does not apply to your Charges as these were for dealing with your request to go over your agreed overdraft limit. Theny are not default charges because you have not broken your agreement. They are our prices for the service we provide in these situations.
    I understand that you may also have some concerns about us sharing your information with credit reference agencies we use, I'd like to re-assure you that this does not apply to bank charges, only white data payments to credit card, loan or mortgage acs.
    I do hope that you can see that we make our charging as fair as possible and why I cannot agree to cancel your charges.
    Referred me to Ombudman etc.,

    I EXPECTED THIS RESPOONSE FROM LLOYDS AND WONDERED IF THERE IS ANYONE MORE IN THE KNOW THAN ME WHO CAN HELP ME TO CONSTRUCT A LETTER BACK...ARE THEY RIGHT? I COULD GIVE UP

    I got practically the same letter from LTSB. My first letter they ignored and I only received this after threatening court action.

    As I'm not going to get anywhere with them and I assume this is to try and fob people off, I guess I just proceed to MCOL?
  • Hi everyone - I am new to the forum and have today sent my letter to YORKSHIRE BANK requesting £1100 for refund of bank charges. I have looked through all the chat and have not seen anyone who has had any money back from Yorkshire!!! Surely someone must have had something?

    Mah, i got the same reply as you and at the end of the deadline i gave them too. I just came on here to ask what i should do about it but i think i will go with you and give it 7 days, what are you going to do after that? move onto the next step? let me know, cheers.

    Yes this has happened to me this week, I am claiming for my husband and I too came home to 70 odd envelopes, his statements only go back to 2002 and there are months missing. The following day received a letter from them asking if we wanted more satements from an earlier date and if so they had a further 40 days to prepare them, its a stalling tactic, I replied stating that they had breached my rights (well my husbands) under the D.P.A and i would be reporting this incident to the information commissioner, i requested missing statements by return. I have totalled charges for the statements provided which come to £2,800, I am tempted to send this off stating that due to their oversight I will be claiming for years 2001 - 2002 when they produce the statement.

    Hi Everyone, just got my Notice of Issue today. The online claim was a bit tricky as I didn't know how to enbles cookies on IE7 but luckily someone at them local court lead me through it----thanks if you are reading this


    My case is registered with the Northampton court which seems to hark back to mediaeval days, as I live within the vicinity of the YB in Leeds!!!

    However, I am happy that I am supporting this issue with going a step further in the lobby for fairer dealings in the coprorate culture, so anyone needing support, just continue with Martin's advice and we could see democracy in action delivering justice where it is due for once!!!

    I think banks and other corporates have relied on the fact that most people in this nation, the most overworked in Europe, are too tired at the end of the day to shop around or pay attention to details, nor can most of us afford a financier or solicitor or accountant to do this for us, and so capitalise on this principle and exploit it for their own ends.

    After posting the last post the missing statements have just turned up, some of the envelopes had been stamped by the post office with a received date, seems like the post office may have delayed them due to the amount of envelopes, may be for health and safety reasons there is an upper limit as to how much a post man can deliver to one address. Anyway, received the missing statements but Lloyds are only going back to September 2001 so I will still send the letter for the ones prior to that.

    My advice would be to wait a few days, the others may well turn up.

    Has anyone successfull phoned the Customer Service centre in Andover? I won my case by default a couple of days ago and wanted to phone them to speed up the payment, but its constantly engaged.

    Is there another phone number for the same place?

    Just thought I'd let you all know,Lloyds have just done the dirty on me.I put a letter in last week asking for our list of charges and they have sent my son 2 letters today.1st one says We are pleased to confirm that the overdraft limit on your account of £210 is availible.Your overdraft limit will be reduced by 10 monthly reductions starting on 2nd aprilAfter the final reduction the overdraft facility will be removed unless you have arranged otherwise with us.So far so good.He owes £230 and we can pay some off that but they dont say how much they will reduce it by each month.With it is another letter saying (and this is the interesting bit ) that they will charge £30 per day up to a limit of £90 per month for going over the overdraft limit etc.Then I open the next letter which is the same as the 1st one only the overdraft limit has already been lowered to £90.so he is already £120 over his overdraft limit and all in one day.Both letters being dated 13th March.So they will put a charge of £30 a day on that from today up to £90.As they have sent the letter stating their intention of the amount of these charges will that get them off the hook when we try to claim them back.Also ,should I be worried about all this or just pay at the end of the month as usual and think it dosnt matter as we will get those charges back anyway.Your thoughts please.
