The meeting about the liquidation of NOC is taking place tomorrow (Tuesday) a.m. in Chester, after which we should receive some kind of report relating to the circumstances that have led to Nuttalls situation.
Never had any 'first hand' experience of this before, so I' ve no idea what info the report will contain, or what the difference is between an unsecured creditor and a secured creditor - we have only been listed as unsecured. As to the actual money side of things, what the female solicitor from B & E indicated to me on the phone last week, gave the impression that there are substantial sums of money owed by NOC, by which I took her to mean that when their assets are added up there won't be enough money to go round.
However, I believe individuals may still be able to get a section 75 refund from a credit card company, it's certainly worth trying. We have not given up trying yet - having spoken to our bank today, the money that we paid (to Nuttalls) through Paypal appears on our bank statement as a Direct Debit. So our query has now been passed to that section of our bank, who have promised to get back to us in about 7 days.
I believe the whole process will be going on for some considerable time to come and we are unlikely to see much progress anytime soon - sorry.

Thanks - hopefully that report will give us some incite.
Does anyone know what claiming money back through section 75 entails - will it mean getting a solicitor, going to court etc or will the cc assist with that?Using my phone to post - apologies in advance for any typos0 -

Court or solicitors should not be needed. You need to file a claim with your credit card company, giving all the details of the order, the company etc. Chances are, they are already aware of this company and have refunded many customers already. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

There's even a template letter there if your card issuer need your claim in writing.0 -
thanks for the response, my claim is already with the cc company, (it was as an item not rec'd but obv now its a company that has gone bust) just wondered what would happen following this - i did have a read of the article this morning prior to posting however just thought someone may have further details.Using my phone to post - apologies in advance for any typos0

If that is because they are just incompetent or have gone bust, it doesn't matter.
Whether, or how, the CC co gets the money from the retailer is not your problem, and the CC co will not expect anything legal from you.0 -
In this case, a Section 75 claim just means that you are claiming a refund from the CC co because the retailer won't refund you.

In fact, seeing as the credit card compnay will be higher up the list of creditors, they are in a stronger position to recover their money. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -
Thank you - appreciate it and glad to hear about the cc company being a bigger creditor!Using my phone to post - apologies in advance for any typos0

:j Can't say how delighted I am to be able now to report that our bank has today refunded the money we paid to Nuttalls via PayPal. As previously stated, the payment originally showed on our bank statement as a Direct Debit and now appears as a credit under the heading of "Direct Debit Indemnity"
The additional court costs of £25 won't get refunded, but that is of much lesser significance as far as we are concerned - it's a smallish enough price to pay for getting the rest of our money back.
I'd like to wish the very best of good luck to everyone else who has paid money to Nuttalls and not received their goods. All I can say is 'don't give up trying.'0
