Nuttalls of Chester - no idea whats going on

  • I am so angry. I placed an order with Nuttalls of Chester on the 5th June for £661.02, the intention was to buy a ring for a birthday present. Payment was made by BACS on the same day. I received an email on the 6th June saying my order was being processed with a 10-14 day ETA. On the 15th June I emailed questioning the date to be sent another generic email saying my order was processed on the 9th June and would be another 10-14 days ETA. I tried the website the same day, it was down.

    Then I trawled the internet and found a phone number to call them. This was when I'd discovered that they'd ceased trading. I sent an email giving them 7 days notice to either sent the ring or return my money. The female director emailed back saying my ring was being made but would be another 10-14 days!!

    I phoned my bank but they cannot recall my BACS, I have to approach them; FAT CHANCE!

    I've approached Company House on the 17th June who were unaware that they'd ceased trading, I reported them to Trading Standards in Cheshire and I've sent a recorded delivery letter giving 7 days notice or I'll take legal action.

    However, judging by the comments on this blog I've got more chance of a return flight to Mars. I am not a wealthy person, they have robbed me of hard earned savings. And what makes me really upset is they obviously knew they were going into liquidation when they took my money. They may as well wear balaclavas :mad:

    ClaireHutcho666, sorry to hear of your problems.

    I would not bother with taking legal action.
    There is no company to sue.

    In fact I think you could have saved money by not sending that Recorded Delivery letter.

    And forgive me for saying it, but why did you send such a large sum of money, to a company that you had not dealt with before, by Bank Transfer?
  • I used Nuttalls previously to purchase 2 pairs of earrings in December 2010, which duly turned up and were of good quality. Therefore I had no reason to doubt them!
  • Can anyone tell me if One stop gold and Cheshire pewter are still trading? Can I claim a refund from them seeing as it's the same owners? :s

  • sadly, i'm another disatisfied customer, i order a ring in December 2010 and six months later, despite several phone calls and emails have not received either the ring or a refund. i have emailed the BJA is there anything else i can do?

    Hi ClaireHutcho666, Although both the 1Stop Gold Shop and I believe Cheshire Pewter, are owned by the same person, I'm certain you won't be able to get a refund from either of those companies, for money that you paid to Nuttalls because each company is classed as an individual and would have it's own account books.

    You are saying that you placed your order and sent money to Nuttalls on 5th June, which in my opinion should not have happened for the following reason: Because we obtained county court judgement against Nuttalls for the money they had owed us since last February, we received written notification of the liquidation, which was followed up by other documents a few days later. What we have is a copy document relating to the liquidation of Nuttalls, that was signed and dated on the 1st June. So although I do not know all the legal technicalities, I find it very hard to accept that Nuttalls should still have been trading on June 5th. What I therefore humbly suggest is that you go back to your bank and tell them this.

    We unexpectedly got the money back from our bank 2 days ago, having originally paid Nuttalls thru PayPal which showed on our account as a direct debit payment. I therefore find it hard to believe that there is nothing your bank can do, given the above circumstances.

    In conclusion, I am aware that we are not supposed to put personal info on these forums, but I will try to help you further if I can.

    The BJA can't do anything because Nuttalls membership of this organisation was recinded in November last year.

    As to getting your money back, it depends how you originally paid Nuttalls - if it was either by a debit or a credit card, talk to the bank or the credit card company, because you may be able to obtain a refund under the section 75 rulings. See the previous posts on this thread.
