Nuttalls of Chester - no idea whats going on

So although I do not know all the legal technicalities, I find it very hard to accept that Nuttalls should still have been trading on June 5th. What I therefore humbly suggest is that you go back to your bank and tell them this.

    We unexpectedly got the money back from our bank 2 days ago, having originally paid Nuttalls thru PayPal which showed on our account as a direct debit payment. I therefore find it hard to believe that there is nothing your bank can do, given the above circumstances.

    In conclusion, I am aware that we are not supposed to put personal info on these forums, but I will try to help you further if I can.

    Thanks for your advice, I've been on to my bank this evening and they're going to get back to me.

    I must say it is bizarre, the bank agree with you and said that the bank account belonging to Nuttalls should have been frozen on the 1.6.11 by the administrators; therefore my payment should have been returned.

    I cannot understand how they were obviously still trading and the administrators were not aware of this fact. I am now hoping that my bank can call my funds back but I'm not holding my breath!

    Would you be kind enough to advise me of who the administrators are or is that considered personal?

    Hi Claire,
    Everyone who has been recorded as having money owed to them by Nuttalls should by now have received the same letter that we got. I'm therefore hoping that it will not be against the forum regulations to advise you that the administrators handling the liquidation are Baines & Ernst located in Manchester. The contact number is 0845 3035 999 and the address is Lloyds House, 18-22 Lloyd Street, Manchester M2 5BE. You need to ask to speak with the young lady solicitor handling this liquidation.

  • Well, I'm happy now. Received a full refund yesterday via the Visa chargeback scheme I started against Nuttalls with Barclays. I thought it was going to take much longer than this!

    Hope everyone else gets what is owed to them.

    Sadly Matt, Nuttals obviously knew they were in trouble and were apparently getting people to BACS/CHAPS the money to them. Unfortunately, this falls outside of chargeback and section seventy-five.

    Frankly any company that asks people to send cash by BACS should be avoided.
  • I managed to contact the administrators and they advised me that Nuttalls ceased trading on the 10/6/11 and were liquidated on the 21/6/11. She advised that they should not have been taking orders from the beginning of June as they had applied to be liquidated - they took my order on June 5th and "processed" on the 9/6/11.

    I'm on the list of creditors now but she advised that it's highly unlikely I will get my money back, and if I do it will be a fraction of the amount I paid out.

    It begs the question: What did they hope to gain from taking money they knew they wouldn't be able to keep hold of?

    Does anyone know if their other companies are likely to be liquidated or are they still allowed to trade under other company names? I think the public should be warned about these con artists.

    The other companies are allowed to trade.

    They are, after all, other companies and have not been liquidated... presumably.

    I am so genuinely sorry to read your latest news!

    Your previous post dated 23rd June said that having contacted your bank again, they were going to get back to you. Have you heard any more from them since that date?

  • I am so angry. I placed an order with Nuttalls of Chester on the 5th June for £661.02, the intention was to buy a ring for a birthday present. Payment was made by BACS on the same day. I received an email on the 6th June saying my order was being processed with a 10-14 day ETA. On the 15th June I emailed questioning the date to be sent another generic email saying my order was processed on the 9th June and would be another 10-14 days ETA. I tried the website the same day, it was down.

    Then I trawled the internet and found a phone number to call them. This was when I'd discovered that they'd ceased trading. I sent an email giving them 7 days notice to either sent the ring or return my money. The female director emailed back saying my ring was being made but would be another 10-14 days!!

    I phoned my bank but they cannot recall my BACS, I have to approach them; FAT CHANCE!

    I've approached Company House on the 17th June who were unaware that they'd ceased trading, I reported them to Trading Standards in Cheshire and I've sent a recorded delivery letter giving 7 days notice or I'll take legal action.

    However, judging by the comments on this blog I've got more chance of a return flight to Mars. I am not a wealthy person, they have robbed me of hard earned savings. And what makes me really upset is they obviously knew they were going into liquidation when they took my money. They may as well wear balaclavas :mad:

    Know how you feel! In the same position. Paid by BACS as the website was offering a 5% discount. Obviously this was a front so hope someone gets banged up for this! They even put a summer sale on their website before it was closed, so they were again breaking the law in my eyes!
