We are both absolutely incensed by what has happened to us, although in comparison with what other people here have lost, our amount isn't that large. Even so, we are not in the habit of throwing our money away, so I completely understand your feelings.
To date, I' ve written letters and emails on this situation to Consumer Direct, BBC Watchdog, Trading Standards in Chester and the Office of Fair Trading. The only organisation who has not replied at all is the OFT, while Consumer Direct gave some helpful advice on the section 75 facility and the other 2 just sent basic acknowledgements. However, what NOC have done to us is fraud and if more people contact these organisations, maybe some proper action will be taken - the address for the OFT is on one of my previous posts; no 57.0 -

Update on our Court case against Nuttalls: Having received from the Court an admission from Nuttalls for the full amount they owe us, we had to apply for 'judgement' - this being that we wanted the whole amount, including court costs, to be settled to us immediately. This judgement was issued to Nuttalls on 3rd June. Today my husband received an email from Nuttalls, saying how sorry they were that our refund had been delayed (yeah right!) and that because they "no longer use the acquiring merchant bank that our original payment was processed through, they cannot use this method to authorise our refund" They then went on to suggest that "we contact our credit/debit card issuer who would reclaim the refund on our behalf". Unfortunately, there is only one main problem here, this being that we originally paid Nuttalls through Paypal (debited directly from our bank account). In addition and even if it was possible to ask our bank to retrieve the money from Nuttalls, the bank would only take back the original amount - which of course would be minus the Court costs and the additional charges to cover telephone calls and 2 recorded delivery letters - clever Nuttalls! I therefore got on the phone and was surprised to find that my call was actually answered - by "Debbie". I explained to her quite frankly that even if we could go down the aforementioned route, we have no intention of doing so, because the amount Nuttalls owes us now includes Court costs and I stated most emphatically that the amount quoted on the 'judgement form' is non-negotiable. I also pointed her to the form they have received from the Court, where it states that payment is required immediately - not in another 3 months' time, otherwise we will go back to the court again and issue further proceedings. I'm hoping that she finally got the message - watch this space!.
Have just received the email form Nuttals about trying to claim money back form bank as paid by VISA. However, have been told by bank that this is only possible if it is within 120days of purchasing. I placed the order in December and their delaying tactics and false promises have taken me well over this deadline. Is there any advice on a next step as this is my first (and hopefully last!!!) experience of this.
Visited the 1 stop gold shop as mentioned on previous comments. Surprised to see there is a link to the Nuttals website on there. Is that not proof that they are linked. Tried ringing them but it is engaged. Has anyone mananged to get in contact with them?0 -
Ask them if you have an e-mail confirming another delivery date -will the 120 day reset. When I rang virgin they said that because I had e-mails with another date on it the 120 days reset (which I was relieved about because the transaction was in January!Using my phone to post - apologies in advance for any typos0

The 1 Stop Gold Shop is certainly linked to Nuttalls and this still seems to be trading (or was a couple of days ago) although the main Nuttalls site is no longer functioning. I have been told today that a person can have one or more other companies still trading even if one goes bust, so the 1SGS may continue at the present time, as although it is owned by the same person, it is looked upon as a different company.
I don't believe that trying to obtain a court order at this late stage would be worth anything at all - now that there is a liquidation case pending. We got ours a month ago, but it hasn't resulted in getting our money back! As to the question about the 120 day deadline, I believe the answer you have already received here is correct. In other words, if you have kept a later dated email from Nuttalls giving a revised delivery date for your order, that may be acceptable to your bank - good luck.0 -

Had some more paperwork through yesterday from Baines & Ernst relating to a creditors meeting to be held in Chester next Tuesday. I expect everyone who is owed money by Nuttalls will have received the same? There were 2 forms we had to fill in and return to be properly recorded as an unsecured creditor. 1 of the forms related to details of our claim, which we were asked to send back with a copy of our court judgement. The second form was to nominate someone to act for us at the above mentioned meeting.
Had no idea who we were supposed to nominate as we cannot attend the meeting ourselves, so spoke to B&E and told that we could enter the name of the Solicitor at B&E who sent us the letter. I was also told that a report will be sent out to all creditors after the meeting on Tuesday which will give some information as to why this situation has happened. I'm sure it will make interesting reading!!0 -

Unfortunately I'm not at the same stage as you - I started my claim with Virgin on the 2nd June as "item not received" so I only received the form and sent it back last week (although when you posted that theyd gone into liquidation I did ring them to find out how that would change the process of getting my money back - they said it wouldnt - which I'm hoping is correct).
