Argos - delivered item not same as picture on website

    If you clearly state that you are selling empty cases, you would not fall foul of any law. However, you if you showed a picture of a PS3 and said that you were selling empty games cases, it would not be clear enough for it be legal.

    As the picture in this case shows a bed with drawers, but does not say it does not come with drawers, it is misrepresentation. The consumer is not obliged to consider that it doesn't come with drawers.

    Funnily enough, a lot of people buy something on the basis of an image, or are you suggesting that if I purchase a black zipped top from an online retailer then I should be happy to receive a red buttoned skirt? It's a bit of a worry for the online clothing industry then isn't it as most of it is sold by photograph!?

    Unless that website actually tells the buyer that "Product images used for illustration purposes only" you would expect to receive the item pictured.

    Can you quote/screen cap that please because I must be blind as I can't see where it specifically says "No Drawers".

    Ok Ok Ok. It doesn't state directly on that page jeez, I was merely pointing out a statement which everyone should know not to buy on basis of an image.

    As Empty game cases. It was actually Empty PS3 cases.

    Do you really believe that?

    Are you seriously telling me that if you saw an image of a Mercedes on a website, with no mention that it wasn't a Mercedes, nor any specific text stating that the image was for illustration only, are you seriously saying you would be happy when a Mini turned up?
