Argos - delivered item not same as picture on website

    If you search for "silentnight rose divan" they use the same pictue for most of the range and title them as 2drawer, 4 drawer etc. I would also complain that you didn't get a double as in the picture ;)

    Well it certainly does not say that it does not come with drawers. Definitely a case of misrepresentation, in my opinion.

    But if you are looking for a single bed you wouldn't be looking at the doubles, so probably wouldn't realise that they used the same image.

    Which has been the whole point, seeing as it doesn't actually say that anywhere. However, that is not always a valid get-out clause.

    You dont need to be a "psychic" to know that.

    If your going to by something on the basis of looking at an image you must be stupid.

    If its that easy i could sell Playstation 3 Empty cases and have it listed and have a description that is within law and make a fortune.

    The image forms part of the offer on which the contract is based. If it shows something which does not match the product, it is misrepresentation.

    Quite a different senario, in fact, somewhat worse. If you said you were selling empty cases, fair enough. If you said that you were selling games, you would be committing fraud.

    Who mentioned games.

    I am selling playstation 3 (empty cases) have it worded to be within legal law requirements. And have people thinking their buying a brand new PS3 just by looking at a imaged used illustration purposes.

    Same with the bed. if you read properly at the description you will see it says no drawers.
