Argos - delivered item not same as picture on website

  • By being a catalogue company, Argos create a situation where the customer is unable to view any products other than via a picture in their book or on the website. Furthermore, for items such as beds, some things are available via home delivery only. This means that, even if the OP had gone into store to order the item, they would not have been able to view it before buying.

    This situation, IMHO, creates a greater duty of care on the part of Argos to get the picture right, with disclaimers clearly stated if necessary.

    Thus, I believe that Argos should go the extra mile with regards to settling this complaint, by swapping the bed for the one that the OP thought they were buying. I'm pretty sure that the difference in price is relatively small change to Argos compared to the OP.

    Mazza111, if I were to look at brochures for new cars, go into the showroom, take a test-drive and decide to buy the car, at what point in the process should I ask whether the price includes tyres?

    Interesting... Argos have now updated the advert....

    It now says on the image "4 drawer double version show"

    I don't think they have gone far enough. The wording is still very ambiguous. It could mean that the consumer will receive the four draw double, if they order the item on that listing. Surely it would have been better to have just changed the picture.

    Lots of adverts are like this though "Top model shown" "model shown is the Sport version"

    Agree it is "misleading" but that's advertising for you. The wording is "Full product Description" down to the number of springs in the mattress but no mention of draws.

    But agree, this is a catalogue shop where it is the image that the buyer initially uses, before moving on to the description surely not too difficult to show a no draw divan?



    Ok, just been through dozens and dozens of bed adverts in Argos. In the title they either say "x draws" or "no storage" "single Divan" or "double Divan"
    then the picture next to it will say "Double with storage shown" etc.

    So based on that, then yes this particular bed advert is inconsistent with the other adverts, as there is no mention in the title there is no storage.
    It's just implied there is from the image. The image might now say "4 draw double version shown" this to many may still indicate that whilst the title says "single" that it still comes with storage draws.

    So agree, title needs amending to say "no storage" or the picture needs changing. to remove the chance of error.

    TBH if this had happened to me, I would go down the route of ooooooops I made a mistake, even though Argos have been misleading, and get a refund under DSR.     Tyres are not an extra. But in theory yes, I would find out the electric windows pack is part of the price. Like ford do with their Family pack, it's an OPTIONAL EXTRA. Privacy Glass, optional extra, metallic paint, optional extra. Tyres are not. Drawers in beds are OPTIONAL EXTRAS. When it comes to optional extras, you have to take care, or things like this happen

    The OP has been very quiet on what she has done regarding this? Is it a 2 Drawer bed she's looking for being delivered, or would she have been happy to get a refund? Have Argos offered a refund?

    They probably don't have a picture to hand.

    The difference is that this was a special deal with no options at all. So if it had no options, then if Argos don't have a picture with no drawers, then they MUST make it quite clear that the deal doesn't include drawers.

    I have already agreed that it was naughty of Argos to do that. I still stand by what I said that the OP should/could have investigated further. Tim we both agree that the OP should be refunded in full. There's really no need to quote every post on that part. ARGOS was in the WRONG. We've established that part. It's on the refund/exchange part that seems to be a sticking point here. That's why I was asking the OP exactly what it was she wanted.

I wouldn't just buy it because it would be clear to me at that point that the photograph was not the actual item advertised.

    If I were in your position, I would use the fact that some of their advertisements specifically state "non storage" to strengthen my argument. i.e. The photo, though you accept for illustration purposes showed a photo of a bed - albiet not a single bed - with drawers. Other advertisements for beds without drawers specifically state "non storage". Based on their advertisements of other non storage items being clear that they are in fact non storage, and illustration of the product you selected for purchase, it would be reasonable to expect that the bed you selected, would contain drawers.

    Perhaps you should go back and read the thread, specifically where it is pointed out that the phrase you embolden, 4 drawer double version shown, was added this morning and not present when OP ordered the bed......
