They have to let you have at least your Statutory holidays.
I'll calrify with my HR guy because. It's pretty complicated, but I'm pretty sure that although they can offer to pay you in lieu of 'contractual' holidays, they cannot pay you in lieu of statutory holidays. Legally they have to allow you to take 5.6 weeks and you MUST take at least 4 of these - they can allow you to carry over the other 1.6 if you don't take them but the CANNOT offer to pay in in lieu of the 1.6 weeks.
So basically if you have more holidays 'contractually' i.e. in your contract than the 5.6 weeks then they can offer to pay you for these (i.e. if you get more than 28 days hols if you are full time).
I'll try to explain with my contract:
I get 35 days contractually and am full time, so 28 days of this allowance is statutoty and 7 days of these are 'contractual' i.e. extra than what I would get by law.
So I have to be allowed to take 20 days (4weeks) and then I can carry over the other 8 days if it is agreed (but they CANNOT pay me for these, I have to be allowed to take them or carry them over)
The remaining 7 contractual days they CAN pay me for if I don't take them.
So in your situation if you have a similar contract to me they would only be able to pay you for 7 days holidays and you would have to be allowed to take the rest or carry it over.0 -
dippy - try looking at hypnobirthing - i havent started yet but planning to, apparently it helps you deal with the birth in a more positive way and helps you deal with the fear of birth. Theres prob lots of free resources on the web too..
Is anyone else having severe hip/leg/back pain? I can't walk on my left leg atm without feeling very sharp pains in my hip/back - how can you tell the difference between PGP/SPD and sciatica?? My dr is rubbish she has just told me that I should just deal with it, and recommended yoga, which is getting painful to do
DH has taken the day off today to look after me but I hate feeling dependent and taking forced restReally hope this lets up soon..in the meantime I am going to my chiropractors next week fingers crossed they can help
I have had a little bit of hip pain, but not too bad. I asked the midwife and she said that they have a special physio clinic that runs once a week and I just need to call and make an appointment to come in. Maybe ask your midwife what they have on offer in your area. Your Doc doesn't sound too sympathetic! :mad:0 -

If a woman is unable to take all of her annual leave in the leave year due to being on maternity leave she must be allowed to carry it over. The European Court of Justice in the Gomez case (see LGE Advisory Bulletin 483) held that a woman must be able to take the annual leave that she is entitled to at a time outside her maternity leave. Although in most cases this should be possible without having to carry leave over, where a woman is unable to take her annual leave before she starts her maternity leave due to the early birth of her child or pregnancy-related sickness absence, for example, or where a woman's maternity leave overlaps with the annual leave year to a signicant extent, exceptions should be made to carry over policies to allow women to carry the remaining period of leave into the next leave year.
This was on the Local Government Employers website. Put that in your bosses pipe and tell her to smoke it! Hahaha!0 -

In my experience..
sciatica is a sharp pain and SPD feels like you are having your limbs ripped off and your back snapped.. it hurts to sit on the loo.. when you first get up from sitting you walk like a zombie for a while. You can't turn over in bed without waking up. opening your legs is just agony and lifting them is worse.. like to put your pants on.

You know, I have just noticed that my tummy starts to move when my little bundle of joy prods and pokes me. It's quite sweet despite it making me think of *those* scenes in the Alien films haha.0 -

Thereafter, you will be entitled to your full annual holiday entitlement each year and there will be no requirement to accrue holiday rights.

Sigh.. I also just had an email saying that my bonus (which is in my contract) will not be paid this year because the company is not meeting its targets. The bonus is not target-related at all, it's a % of the company gross profit.I know it's not much to complain about, but I just don't need all this extra stress at the moment.

Thanks pigpen and lovecake - i dont think i have SPD unless this gets worse as I have no problems separating my legs or any pain in the pelvic region, and I can turn around in bed etc with just a bit of pain - really bored sitting around so am trying to figure out what I have as I don't really trust drs opinions on this issue!
I have called my midwife and waiting for a callback, hope they can refer me straight to the physio rather than waiting for my dr to come around!We got rid of the kids. The cat was allergic.

I would say that you maternity leave does overlap you holiday year by a significant amount so that should be enough reason to argue the case to carry it over, but if you don't know that you will go back then that is no use really. Hmmmmm, tricky situation, but I would fight your corner if I were you. Unless she can present you with a significant business reason as to why you cannot have your hols before you go then you should be allowed to take them. I think the first port of call is to try to resolve it with your employer, but if you can't then maybe take some advice from ACAS or CAB on the next steps. Annoying!

Mogwai - poor youHope you get it sorted soon. As pigpen said you might be able to refer yourself. We get a list of all the phone numbers we need relating to our pregnancy - if you have a list like this there might be a number for the physio? We are allowed to just call up and make an appointment.

Thanks lovecake and pigpen, I just looked into self referring and they don't do that in my PCT
Its a shame how drs just brush off pregnancy related ailments, I've heard from a couple of friends how they were told to just deal with this kind of problem without much in the way of support or advice - I guess you just have to be persistent and chase it up yourself which I plan to do!
