Hello everyone,
I never thought I would be logging back in here as I thought those that were remaining with Clode seemed to be receiving a decent service with some people even praising the customer service. ( contrary to the beliefs of cynics like me. )
However a litle incident yesterday and the day before prompted me to log in and check how everything was going, expecting this thread to have continued to show no further posts.
Yesterday I received a letter from belfast returns of a recorded letter I had sent to Mr Jessa at Castellian Court in London and the day before I had received a similar one which I had sent to mr Gulzar at the same address --truly a blast from the past.........so I logged on.
I cannot believe the posts here --definitely deja vu!!!!!!
For those who did not learn the lessons of the past or those who were unaware of the lessons learnt by nedmundo, JayPee, others and myself, here's what to do.
After 2 years there can be no doubt of the inability of Clode to run a menage, never mind a financial service or unbelievably any IT facility.
Therefore once again, as in shakespeare, " take up arms and oppose them "
Some advice on getting out with a view to not losing out.- Write to them via email or post informing them of their failure to supply the service or any part of the service. Ask to re-instate the failure or give you reasons why they cannot and also supply a mac code.. Keep a copy.
- Give them 7 calendar days to respond positively.
- If they do not respond positively in the 7 days write them a further letter, stating
b ) that you have given them the opportunity to provide redress.
c ) that you are withholding any further payments until the matter is
resolved or is determined by the courts .
d) you are giving them fair warning that if they fail to provide you
with the full service within a further 7 days then you intend to apply
to the county court for a judgement in your, the claimants, favour.
You will also be asking the court for an order for a mac code as
part of that settlement.
e ) you should also advise that you make the following offer to Clode
if they want to avoid the additional expense of the above---that
they release you now from any further financial obligation in
respect of the broadband contract that they have failed to deliver.- Send this letter by recorded delivery post and email. Keep copies.
- Get the money claims forms from the online claims web site.
- Fill them in, with citizens advice bureau help if you need it.
- Claim for your outstanding contractual debt, the cost of claiming the money thru the court ( about £28 ), and any other expense you have had, postage and telephone etc.
- If Clode do not respond positively to this letter after 7 days, lodge the money claim online. State you want any case heard in your own home county.
To Note:
DO NOT pay them any money to get out of contract.
DO NOT be afraid of the claims system, it is actually quite simple once you start.
REPORT Clode to the authorities by all means, its already been done, but DO NOT rely on their interventions being any help. ( as they say –been there done it and got the tee shirt. )
Good luck everyone. The lessons from the past are----
1. Dont hang around waiting and hoping it will be allright ---it wont --we know.
2. Don't pay them money to get out---they're at fault not you --and its not needed. Many of us got out and Clode had to pay us.
Hello to all the oldies ---is it not wonderful to be frree?

Hi FCI
Glad to see your still around, like you I pop back in now and again to see how things are going, I still receive messages via the Deadten site from people who have only just started to make a claim against Clode, can't believe it's taken some of them so long to start down the road to enlightenment.0 -
Hello Essex,
Thanks for that,
It's a bit like old times seeing these posts. Of course we knew it would happen but I guess we had hoped for those left behind that it wouldn't.

Likewise FCI. Received returned RD nearly six months after sending it to Jessa. Sorry to hear that people are still having trouble. Just follow the sound advice of those who have been through all of this and have escaped.0 -
I've received a letter this morning from Clode releasing me from my contract with immediate effect. Also contained was my mac for transfer to another ISP.
This is for the contract I took out as a 'present' for my dad nearly 2 years ago, so approx 13/14 payments remain.
He is not a heavy user, nor have I been in touch with Clode at all during this period, expecting them to have folded on a daily basis since April this year.
To sum it up, payments have ceased, they won't be calling on the Direct Debit and have issued my mac all free of charge.
Goodbye and good riddance to them. It felt like handing over a duff present and having to justify it for the last year or so.
Cheers

The last 2 posts that say they have received a letter terminating their contract....have either of you been in contact with clode recently requesting to be released from you contract?
seems strange you should get these letters have you or are you still getting a connection ?0 -

Still a normal connection (at my dads - although he only uses ebay) - however I do have a much younger brother at the same address who spends all his spare time gaming and downloading xbox live demo's, so perhaps he's a heavy user and that's why they have bumped his line.
Never contacted them once, apart from dealing with inital telephone support at time of delivery of goods. :beer:0 -
i too have had the letter
try to leave - get nowhere
then get told they are "unwilling to supply" cheeky gits
if you're still stuck just threaten them, that's all i did0 -
