    It is now 45 clear working days since you signed for my recorded delivery letter concerning the breach of our contract, in that letter I asked for you to terminate our contract and to supply me with a MAC code. As you are aware you are obliged by law to provide a MAC code within 5 working days of receiving a request, having already spoken to OFCOM 9/04/08 and I have been advised to inform them if no MAC code has been received. I have duly informed them of the situation today and shall continue to do so on a daily basis should this be necessary.

    Jaypee - i too had to send (counts) 20+ emails, 2 RD letters, numerous calls etc. to get my Mac code - and it was only after issuing court proceedings that I got it.

    I too sent a very similar email to yours.. Clodes response? "We are not regulated by Ofcom" - mine "oh right, that makes it alright then".

    Anyway, hope things are different now bearing in mind Clode are definitely in control... cant believe this whole mess is STILL going on.

    Use the system folks. send RD letters, follow up with call/email then, if no joy, issue court proceedings. I guarentee you will be released.

    The courts will not take kindly, as you have to be able to show that you have given the defendant every chance to correct the problem prior to issuing court proceedings. Hence the recorded delivery letters, it provides the paper trail necessary to show that you have been reasonable and that the defendant has not responded.
    I know it is a pain but that is the system I'm afraid. Keep a note of all costs as if you have receipts you can add them on to any claim.

    Quick update here. I rang these guys and said that i consider 125 pounds to be way too much citing the breach of contract etc. Anyway i then requested my mac code and the fella gave it to me right away! He said it is valid until 14th Nov. My question is this , should i cancel the direct debit and use the mac code to join another isp? The way i see it i will have done no worse than redten. Would i be justified in doing this and what if any repercussions could i face if i did this. The fella said he has noted my reasons for not wanting to pay the 125 and said someone will call back but as we all know they may never ring back. Any advice greatly accepted.

    I've been reading this thread since the start; however this is my first post.

    I took the option of taking my MAC when the BT walled garden occurred (my life is not worth living if my wife doesn't have internet access). I switched to O2 as my wife is on contract with O2 and she is gets a £5 discount on the internet package. BTW, I recommend O2 to everyone, superb service, no down time or slow downs, and added to that the guy at O2 advised us to take the cheapest package as our internet speed is not fast enough to merit paying for the other packages...who else does that? blows ISP's promoting high bandwidths out of the water. So whereas I was paying Redten/Clode £19.99, my wife is now paying O2 £7.99 (£12.99 less £5 discount)...how good is that.

    So how does this help you? Well, I did not contact Redten/Clode, but instead waited to see if my Direct Debit would still be taken, even though the service was no longer provided by Redten/Clode. It was, so irrespective of all the advice on this thread I took the decision to cancel the Direct Debit. I received a couple of standard letters from Clode stating that they could not collect my latest payment etc, etc, which I ignored (as it is bliss) and then eventually after a few weeks I received a letter from Clode stating that the account was closed and that there was no further payment required. Note that after a few more weeks I registered for the free trial period of CreditExpert.co.uk and confirmed that the account was closed and that no defaults had been recorded by Clode.

    I appreciate that your situation is not exactly the same, however, I did take my MAC to a different ISP, and I did cancel my Direct Debit and I am now Redten/Clode free. The pedantic would say it cost me another £19.99 which I could have claimed back if I took the courts route, but who needs the hassle.

    I hope that this information is of some help to you in making you’re difficult decision.

    I've sent letters,emails,all saying the same thing about breach of contract etc,and received the ridiculous letter re the £150/£125 get out clause.I sent more letters and received a rambling letter about the claims procedure,saying that I can go to the Financial ombudsman if not happy.Now I have 3 identical letters:
    Dear Mr Thomas,
    Further to my letter of 13.10.2008,I am still investigating the detail of your complaint.I will write to you again in 2 weeks with further information regarding the detail of your complaint.
    And as requested here is your MAC and is valid until 23.11.2008
    However I must stress that you still have the financial agreement with us.
    If you need to contact me in the meantime,please do not hesitate to do so on

    I feel that if I use the MAC and migrate it will weaken my position,what do I do?
    I'm currently jobless so can't afford court.
