  • These guys are a joke. I got the offer of 125 pounds to buy out of the contract. I rang to enquire about it and got a return call this morning. I hadnt my wallet to pay there and then so suggested that he call me tomorow morning (15/10). This evenig my width is about down to about 600kpbs from about 5 meg. Coincidence ? I think these guys will stoop to anything to ship customers at this stage.theyre obviously haemorraging cash and i bet the credit crunch hasnt helped them. Still 125 is probably worth it to end this fiasco. Good luck to the few bedraggled passengers left on the fast sinking fat cat dinghy.

    Dont do it Gringo - tell them they are in breach and have changed the service without informing you - therefore you want out without penalty/payment.

    If they refuse then say you will have no alternative to take legal action - and do it. Dont give in - they are forcing peoples hands here and its not right or fair. Like you say £125 seems a small price to pay to get out. It isnt - and you dont have to pay it.
  • Some info that may be useful :

    The Controlling Party in Clode is a man called David Mills who also controls a Company called Quayside Corporate Services Ltd. and another called the Sandstone Organisation. If you're having problems getting the right answers from the people at Clode, maybe you should ask David himself to resolve issues. However, I suspect he does not spend much time at Clode's offices and you may be better trying to contact him via the Parkmead Group in Vigo Street, London, which is the last trading address I had for Quayside.
    I also suspect the people at Parkmead will start having palpitations if anyone looks for Mr Mills via them (Parkmead Group bought Quayside in 2006 for approx. £8M and sold it back to him in 2007 for £630,000 with a further £1.9M to be paid back by this November. So what ever way you look at it, Parkmead have lost over £5M on the deal and are possibly a bit touchy over the whole incident which, incidentally, has still left Mills as their biggest shareholder).
    It may be that trying to track him down at Parkmead will speed up resolutions at the Clode offices. But I should get in quick because Clode are heavily funded by HBOS (I have even heard a rumour they are a division of HBOS) and who knows what will happen if the Lloyds deal doesn't go through.
    I have this info because I have spent the last 18 months investigating Quayside, Bank of Scotland and a rogue bank manager who the Bank have since sacked. I and thousands of others (Company Directors, shareholders and unsecured creditors) are victims of their actions.
    Anyway, I'm sure David Mills is the man you need to get things sorted! Good luck.

    Just thought I would say I'm still around unlink Redten/Fatcat Jessa and the rest. As we are now way down the line and I couldn't give a stuff about what legal implications there might be. I'll tell you the terms of my deal.

    Clode released me fully from my Contract. I had about 20 months to go at £22.99, I didn't have to pay a penny, in fact Clode paid me £60, in return I had to take down the www.deadten.com website.

    The fools were so stupid that they didn't nail this down very much and all I had to do was move everything over to deadten.co.uk

    I've since moved back to BT, the service isn't as good as I was originally getting as I no longer get a static IP which I really wanted but at least it works and gives good throughput.

    Looks like there are still a few people out there fighting Clode. My best advise don't give in, Using the Moneyclaim online service. For once the customer is in the right and Clode don't have a leg to stand on. They will soon back down once court papers are issues and you should be released without any payment. Don't give in to them. They have had enough of our hard earned cash.
  • Well after writing to clode I got an offer from fatcat saying that if I paid £125 I could be released from the contract.

    I wasn't sure what I would do and while pondering about a week later I got a letter from clode releasing me from the contract with immediate effect with no penalties :T

    My original post is on page 311 post number 6203, my case is slightly different than others.

    here is a copy of my letter (I found help at deadten.co.uk)

    Dear Sir/Madam
    I wish to cancel my agreement with clode for the service that I signed up to with Redten Internet.
    I have never been able to connect to Redten Internet since it changed to NJP and now Fatcat. I have been without an internet connection for most of this year.

    I now have an internet connection with Virgin and I am 100 percent happy with their service.

    I believe Redten breached the terms of my original contract and as such I would like to be released from the contract without penalty. I have listed these breaches below :-
    1. Failure to give notice of the contract change and its details and allowing me the opportunity to reject it.
    2. Failure to notify me of my consumer protection rights at the time of the change.
    3. Providing a lesser and degraded service.
    4. Instituting a cap and blockage on my broadband connection and access when your contract was for unlimited and uncapped service.
    5. Failing to provide me with a service for a number of days in the month following their application of a cap on the service.
    6. Failing to provide any information on any of their proposed changes yet giving public statements to the press which outline a detrimental service.
    7. Failing to provide reasonable duty and care in the provision of a service to me.


    Thank you for dealing with this.


    Like I say my case is slightly different - the fact I had cable meant that at least I had an internet connection and maybe didnt pursue it as much as I would have if redten was my only connection.

    Just out of curiosity, what do you all think Clode would do if I cancelled my direct debit after being offered a £125 get out? I would do this if I knew how I would then get my MAC code. Any ideas?

    I phoned another ISP to see if they could in some way intervene (not interested), but gave a wry laugh when I mentioned it was Redten.
    Anyway, the salesman I spoke to told me that they must give you your MAC code regardless by law.
    I haven't done this myself yet as I've been busy recently and frankly could do without all this hassle.

    Cancelling your direct debit on it's own is not enough, you are quite within your rights though to say you are suspending payments until your account is put right, I took this step before issuing my court papers, they sent me a letter at first saying I had missed a payment but once I spoke to the head of collections at Clode he was fine with the suspension, make sure you write to them to tell them that you are suspending the payments as you could get a black mark against your credit rating for failing to make a payment.
