  • Spoke to Clode on Monday, 0844 844 4700 or 4705. Talked about no email servers was told by the first
    person that they were down but they may be coming back online. The second person said they had been
    switched off and would not be coming back. I said that I wanted to terminate my contract and was
    told I would have to pay it off in full. I told them that this was not the case as they were in
    breach of the contract. They said they were not contracted to supply POP email, they were contracted
    to supply Internet connectivity. We agreed to differ and I started to calmly negotiate for a price
    for release, court action was not mentioned. We agreed that I would pay 40% in return for the
    account being terminated, them supplying me with a MAC and all installed equipment is mine to keep.
    The deal was done and they confirmed it there and then via email (Yahoo Webmail). I accepted the
    offer and Clode were to ring me on Tuesday for me to make the payment by debit card. No call by lunch
    time so started phoning them. About 3 O'clock the payment was made and I asked them to email me my
    MAC code, which they did immedieatly. Free at last. I've cancelled the Direct Debit and signed up
    an alternative ISP this morning. I'm sure I could have got a better deal, but I was so fed up with
    the whole situation, I just wanted out. Which I now am.

    oooh i can feel the clode/redten hackles rising again.

    Come on Clode, terminating a service without warning? Regardless to whether or not you are contracted to supply email you ARE contracted to warn people if you are stopping part of the service - hence you have breached your own T&C ipso facto breach of contract (again)

    I really really REALLY wish Clode would go to the wall, it makes me so angry that people are treated this way. Congrats on getting out BBPC but i suspect had you taken them to court they wouldve settled no charge.

    Have just spoken to Nick at Clode tech support. Email server has been taken off line and apparently there has been a letter drafted (but not as yet sent)that we should all receive informing of this action. Seems unlikely that the server will be back but the internet connection will continue. Isnt it great customer service when you have to contact them to find out what the hell is happening with the service that we are still paying for!

    Its really poor service is that.

    In fact, they may have even breached again by changing the service without giving prior notice...

    This is ANOTHER opportunity to get out of you want to people.

    Clause 12.12 of redten T&Cs of nov 06 state: " Should we increase the Charges or make any Contract modification, which is likely to be of material detriment to you we shall provide you with 14 days written notice and the increase or modification shall take effect from the end of that period. If this occurs you may be entitled to terminate your contract by giving us written notifice detailing the proposed modification increase or detrimental contractual modification at any time on providing us with 10 working days notice, such notice to expire before the price increase or detrimental contractual modification takes effect. If you terminate your contract in these circumstances the relevant provisions of this clause 12 shall apply."


    As they did not notify you of any changes ie: email going down, they are in breach of contract.

    Unfortunately I think you will find that those Terms and conditions are no longer applicable.

    The new terms and conditions which those who stayed with NJP/Fatcat or whoever the current supplier is, agreed by default, to them, and they had a myriad of get out of jail free clauses, allowing them to do a lot more than the original Redten contract, I am afraid that those who did not reject the T&C's within the 15 days (or whatever the timescale was, as I have been to bed since then) may well be stuck with what they are given.

    I hope there is a get out for people still stuck, but I suspect they are few and far between.

    Sorry to be the bearer of bad tidings but it will be necessary to read the current T&C's for escape routes

    Does anyone have any idea on how to find the current Terms and Conditions for Clode/Redten/Fatcat/NJP as I certainly did not recieve any notification of changes to my contract,
    Then again, I suppose expecting notification of any change is asking far too much from this company!!!
  • I too contacted Clode on Tuesday, spoke to Nick said Louise would ring me on Wednesday which never happened, I rang on Wednesday and spoke to Louise, closed my account, I settled for £100 - £300 left on account to pay - got my MAC, signed up to O2 last night and have emails straight away. I'm free.
    I would like to thank all those that have contributed in the past and made valuable information available to us poor mortals.

    Fatcat CS informed me back in July that the original contract with Redten was still in force as Fatcat have not made ant T&C's just their FUP which in itself was totally different to the one in place when the majority of us signed up with Redten.

    However there were T&C's published on NJP portal back in May (
    Redten Max Package ) Clause 16.3 below states,

    16.3 Either party may terminate this Agreement immediately, on notice if the other:
    (a) commits a material breach of this Agreement, which is capable of remedy, and fails to remedy the breach within a reasonable time of a written notice to do so; or
    (b) commits a material breach of this Agreement which cannot be remedied; or
    (c) is the subject of a bankruptcy order, or becomes insolvent, or makes any arrangement or composition with or assignment for the benefit of their creditors, or goes into voluntary (otherwise than for reconstruction or amalgamation), or compulsory liquidation or a receiver or administrator is appointed over their assets.

    Removal of email services would be deemed to be a material breach, providing you were not given written notice that the service was beinng stopped.

    You should ring Fatcat(Mr Will Tilbury) to confirm the T&C's though as i might be wrong as Jaypee has suggested.
