With regard to the supply of pop 3 email accounts, Redten if I remember rightly gave you up to 5. in a letter from NJP dated 12th March 2008 they say "NJP Services offer you unlimited POP 3 mailboxes to allow you to provide each member of your household with their own email address"
In the letter from Fatcat dated 20th June They say "I am pleased to advise you that with effect from 20th June 2008 Fatcat Communications Ltd has acquired some of the assets of Reten Communications Ltd and will now be responsible for the provision of your Broadband Service under your existing contract with Redten"
"This transfer does not affect the terms of your contract in any way"
Question is, how does the above affect the email question raised by Clode regarding not being responsible for it!!0 -
Hi everyone,
can anyone tell me if Clode are still being investigated by the FOS? I read on here some time ago that they were - God knows they should be!0 -
Fatcat CS informed me back in July that the original contract with Redten was still in force as Fatcat have not made ant T&C's just their FUP which in itself was totally different to the one in place when the majority of us signed up with Redten.
However there were T&C's published on NJP portal back in May (
Redten Max Package ) Clause 16.3 below states,
16.3 Either party may terminate this Agreement immediately, on notice if the other:
(a) commits a material breach of this Agreement, which is capable of remedy, and fails to remedy the breach within a reasonable time of a written notice to do so; or
(b) commits a material breach of this Agreement which cannot be remedied; or
(c) is the subject of a bankruptcy order, or becomes insolvent, or makes any arrangement or composition with or assignment for the benefit of their creditors, or goes into voluntary (otherwise than for reconstruction or amalgamation), or compulsory liquidation or a receiver or administrator is appointed over their assets.
Removal of email services would be deemed to be a material breach, providing you were not given written notice that the service was beinng stopped.
You should ring Fatcat(Mr Will Tilbury) to confirm the T&C's though as i might be wrong as Jaypee has suggested.
I hope I have'nt confused anybody
Hi Cire
You don't have to confuse anyone, Redten/Clode did that months ago, if people want to check on the https://www.Deadten.co.uk under the following headings they will find the various terms and conditions
under Resources there are the version 1 and 2 of the T&C's, and the T&C's they posted on the net
under Add content there are the T&C's for Fatcat which appeared briefly online then disappeared, whether these ever came into force or not I do not know.
Each version of the T&C's closed more avenues of escape
Even version 1 according to my solicitor, had a number of get out of jail free cards in them, but they could be challenged in court, which is why I suspect Clode chose to settle the full claim with those that took the case to court, later versions just contained more.
I do not know what T&C's are currently in force as I stopped caring when I escaped, but it could be interesting for someone to ask Fatcat or whoever the supplier is now for a set of their T&C's and submit them to the deadten site.

Here's a gem, had a second letter today confirming closure of my account along with a offer quote "We would like to take this opportunity to thank you for your past custom, and assuring you of our best attention at all times.
As a valued customer with Clode I would like to take this opportunity to draw your attention to our fantastic new Homeowner loan facility. This product is ideal to consolidate all your existing debts into one monthly payment, reduce your monthly credit payments.
If you're a homeowner you can borrow any amount from 5,000 to 100,000 GBP over periods of 5 to 25 years. Rates range from 6.7% to 13.4% APR varaible, with a typical rate of 8.4% APR variable".
Don't all rush at once!0 -
Does anyone have any idea on how to find the current Terms and Conditions for Clode/Redten/Fatcat/NJP as I certainly did not recieve any notification of changes to my contract,
Then again, I suppose expecting notification of any change is asking far too much from this company!!!
Go to https://www.deadten.co.uk under the Resources tab you will find the Redten T&C's version 1 & 2 along with the further revised version posted online, and if you look in the Add Content tab, you will find Fatcat T&C's .doc which were briefly posted, but am not sure if they ever came into force.
There may have been others since that I am not aware of, but that should help I hope.

The latest episode starts with another letter, this time from Clode, saying that FatCat have been given the old heave-ho and Clode will now be running the service themselves. The new service will be an ISP only service - no webspace, no email, but still under hte same FUP conditions.
They also say that although the normal charge to remove yourself as a customer is £150, they will let you go for £125 and you get to keep all and any hardware that was supplied.
Looks to me like they are trying to get rid of their customer base at the best price they can - question is whether the get-out price will drop further in due course?0 -
Do you know what, if I didnt have an intrinsic HATRED for anything clode/redten etc. id tell everyone to stick with them and (sticking to the FUP of course) download as much as is reasonable.
Clode dont want to carry on this service but realise they have to. There will be some who pay £125 on this offer. I urge you not to. You can get out of this for free - they have changed the T&C now waaay beyond a reasonable change so i urge you all to ask to be released due to breach of contract and if they refuse, agree you are deadlocked and start the court ball rolling. See how much you have to pay then!0 -
I got same letter too cheeky sods, telling you to get your own free email else where as they can no longer supply it full stop
then assuring you they will supply a top class service but oh yes PS if you want to jump ship it will cost you £150 BUT as a GOODWILL gesture (cough) they will let you go from this A1 service for £125 Gee thank you so much
Dont know wheter A coincidence but my speed dropped from 4 gig to 512K yesterday and I am a light user.
I suggest everyone keeps an eye on the speed as they might use throttling tactics to make people leave!!!!!
Today speed is at 2Mb but all the time I have been with this bunch of Cowboys the speed has been steady at 4 Mb .....so watch your speed folks!!0 -
Why don't they just accept they made a mistake in dealing with the Jessas, cut their losses and just let everyone go!
You could threaten them with a toothless government regulatory body - that might just scare them into doing the right thing.
Seriously, starting court action is the only way to get them to back down.
Good luck to all those still stuck with them.Beware the character seeking personal gain masquerading as a moral crusader.
