Everyone who gets this letter should ask to be released immediately at nil cost due to breach of contract.
If Clode refuse issue court proceedings - no court in the land would find for Clode and this £125 "offer" is the biggest try on ever.

Living in the wilds, I've never really had very fast speds (about 1Mb to 1.5Mb) but since I got the letter from Clode (dated 6 October) about being able to buy myself out of the contract, its dropped to les than 400jb. I've emailed the technical support but heard nothing yet. Is everyone getting slower speeds?0

My download speed is also being throttled back.
Until 24th September it was a steady 2.3 to 2.7 mbps. (Rural Line).
It stays around this during the day but drops to 0.3 to 0.4 mbps in the evenings.
This sudden slowdown happened on or around the 24th September.
I have sent a letter, re. breach of contract to Clode but as yet have had no reply.
Here's a little gem though.
I have phoned Clode several times to speak to the Redten desk only to be told they do not accept incoming calls!
What a way to run a customer service department!!!!!!!!!

Yep same here speed during day same as normal about 4.5Mb at night owt from 512K TO 1.5Mb.......:mad:0

Got the same letter as the rest of you, spoke to them and could not get released for nothing although someone else is supposed to be getting back in touch with me. is it not the biggest breach of contract of all though now that Redten Communications is in liquidation.0

There is no customer service department, never has been, all Clode have ever been interested in is keeping the losses sustained by Redten's collapse to a minimum. When I finally escaped from these cowboys, I had spent 10 days on the blistering speeds of 0.012 mb/s to 0.026 mb/s max.
The only positive response from them has followed court action, when it would cost them more than they were saving.

I am sorry to say that I did not pursue through the courts, I had a solicitor looking at the case, but he was slower than the speeds my service was running at! :rotfl:I asked for settlement figures to start proceedings and they made me an offer of £80 get out there and then, which I took just to get a mac code, I regret that I didn't go the small claims route that FCI, Essex and others took, I believe they got out for nothing and a refund of the money to file in the courts.
I still did the right thing by getting out though, I now have a stable supply (with pop3) and wonderful nights sleep.
Everything you need to file your claim is on Essex's Deadten site, go for it and good luck, if nothing else you will regain your sanity.

I took court action against Clode and settled at no cost to me (other than the court fee which i didnt pursue as I was happy to get away).
The link to the online court application site is on deadten. Basically you need to claim for the balance of your account.
In the particulars bit I waffled on about how CLode have breached my contract of service by not supplying what I originally signed up for... let me see if i have a copy.. yep, here is what I put (but you may need to change some of it re: new t&c
"...I signed up for unlimited internet access with Redten Communications in November 2006 at a cost of £719.64 for 3 years internet access. This was financed by Clode Retail Finance Ltd at 0% interest [be careful here, their defence was CRF werent funding - it was Clode Funding Ltd] and therefore I paid a monthly amount of £19.99. The contract was for unlimited internet access provided by BT with a free upgrade to 24mbs when it became available. As an inducement to enter the contract i was provided with a free desktop PC. On 11/3/08 my internet service was disrupted by what is known as a "Walled Garden" message from BT stating Redten had not paid their invoices. Service has switched to an inferior provider, NJP services without warning. Service is slower and is not unlimited, furthermore it is not provided by BT. What has followed is a protracted series of emails and letters which has ultimately meant deadlock between myself and Clode. My claim is for the balance of my account plus 2 payments made for an inferior service.."
I should point out also that i didnt get the 2 previous payments back - but I wasnt too bothered about that - they put in a defence but about a week or so after that, wrote to me and offered to cancel.
At the end of the day, this is the only way out folks - so get writing those RD letters to Clode (as you would need to prove you took all reasonable actions prior to going to court) and get the ball rolling.0 -
For anyone who wonders what RD refers to, it is Recorded Delivery, sorry Gnipper and to those of you who may find it obvious.
