    I have checked this out with my legal advisors at work and they have stated that describing a service as "unlimited" on one hand and then talking about a "shared pot" and "buying extra bandwidth" on the other is unlawful and misleading. They suggested we:

    1. contact Clode / Fatcat as soon as possible to reject this change to our T&C;
    2. contact their Home Authority, Cardiff Trading Standards ( [EMAIL="tradingstandards@cardiff.gov.uk"]tradingstandards@cardiff.gov.uk[/EMAIL] ),highlighting these illegal terms;
    3. ask which ADR Fatcat are registered with and complain to them;
    4. if no joy complain to Ofcom;
    5. if they promote this service in any way complain to ASA;
    6. submit court papers if no already done.

    I have already done1,2,3 and 6. I will let you know if they reply.

    To Redten, Clode, The Jessa's and NJP/Breathe/Murphx, I'd just like to say that I believe Karma exists and what you have put innocent and law abiding customers through is unforgivable. I'm glad to be shot of any further dealings with any of you.

    GOOD NEWS: Sent off my emails regarding my last post just before posting, now I just got this email from Fatcat accounts:


    Dear Customer,

    It has come to our attention that there has been an excessive bandwidth usage on your account. This is due to peer to peer downloading, networking and downloading excessively. Regrettably in light of this problem and in order to be fair to all our customers, we have had to slightly limit your bandwidth usage in line with our Fair Usage Policy.
    Normal service will resume at the beginning of next month as long as you adhere to our Fair Usage Policy.

    As I have only used 0.4Gb since I could access the FUP this will go down as excellent evidence against Clode. They still cannot provide an unlimited service.

    Not too bad at the moment, seems to be about 1/3 slower than usual but maybe they haven't activated it yet. :confused:

    Got the same email around 20 mins ago, I had used around 30Gb this month, cant log in to member service area as it says access denied so I cant check. Not quite unlimited is it? Nick Davies said they didnt have a case to answer as I was back to unlimited as per my original Redten contract. Nevermind the fact that for the past 4 months it's all been restricted and seems that trend is set to continue.

    Thats the link that wont let me log in, and whether I have used 30Gb or 130Gb the simple fact is it's not unlimited by any means no matter who is running this mess. They need to listen to what is being said as these emails and t's&c's prove its not what we signed up to, and its not a good advert for new customers.
