Hi
Fatcat have posted these T+C's on their website
http://www.fatcatinternet.com/fair_usage.aspx;
Fair-Usage policy...
...I think it looks the same as the RT ones. It certainly doesn't have anything about email attachment sizes or streaming video.
Any thoughjts?

had a long hat with fatcat earlier today - they say they don't have a hard and fast rule yet on what is fair use, but claim that some people are downloading as much as 40gig a day (that's who they're targeting.)
tried getting a definitive answer but not forthcoming, so asked what they thought about 20gig in a month. they said be careful. hardly unlimited.
they said they knew nothing of the traffic light warning that has been talked about and also that peak/off peak times made no difference.
they also said the t&c's posted on this site are not theirs, but to keep checking back on their website where they should appear sometime!!!???
asked about the origins of fatcat - they said existed for about 2 wks - partner of clode - have bought elements of redten - don't know if redten still exists.
what can i say? they answered the phone instantly - that alone blows redten out of the water - i wish i could trust them but i still have serious doubts - we've all been screwed over so many times
they said just give them a couple of weeks to prove themselves - but i'm concerned about the ticking clock
Personally I dont trust any of them, I had an interesting conversation with trading standards and ofcom the other day, for obvious reasons it's not something i can post on the forum.
Im fed up with all the twists and turns with all this and the fact none of the companies involved will take any responsibilty just proves none can be trusted.0 -

edit: i've decided i'm going to hit my connection hard over the next few days to get my month usage up to a decent figure and see what response i get
Try downloading a few programs from I-Player the BBC don't miss any program site, it is a perfectly legit site and each program is 300-600 mb depending on the length of program. This is what the internet is all about nowadays, convenience, and the ability to watch what you want when you want, hence the desire for unlimited broadband.
It will be interesting to see the results.
However it will still prove nothing as fatcat can ignore high bandwidth in the short term only to clamp down once things settle.
Your choice folks.

Luckily I got out before allowing them to connect me, so all I'm down is the £50 connection fee (or deposit according to the Clode Finance details). Haven't had that back surprisingly, and I've written, e-mailed and spoken to Redten and Clode on a few occasions about this and cancelling (which they eventually did).
Could someone please tell me exactly what I need to write to legally threaten court action and whether or not Clode Finance are also responsible for repaying me what I am owed? This is for an order from around October 2007.
I know it isn't much compared to what some have lost but I could really do with the £50 back.
I was in a similar situation about four years ago - paid about £85 for modem and connection fee on credit card. Complained to card issuers who asked for more details - any paperwork with address etc and copied something from internet confirming that no one was able to contact them and no one had been connected 2 or 3 months after payment. Less than a week later my card was credited with full amount - still got modem as there was nowhere to return it . As I remember it the service was either £9.99 or £11.99/month - incredibily cheap at that time - so cheap it never happened.
At least redten lasted over 4 months for me. I'll learn one day.
I'm also a "card merchant"
A couple of years ago a customer bought an item which we said woudn't really do the job but insisted on buying it anyway - got home and decided we were right - complained to card company (Not us) that item was "no good". Card company gave us 7 days to sort out or they would "chargeback" the sale. Similar situation if customer disputes a postal transaction and we can't supply proof of posting or carriers receipt to cardholders address, the amount is charged back. The customer does have a lot of "rights" where credit cards are concerned and its the retailer that has to do the proving - not the customer.0 -
Thanks for the information. I'll look into that.0

Hi Casey, welcome to the madhouse!
I've been attempting to get my £50 back from Redten (it is them and not Clode as far as I'm aware) and have gone down the small claims online route. I have a judgement, which was not defended, and I now also have a warrant which has been sent to the bailiffs at Bow County Court for action. God knows whether I'll ever see the money (or my costs of filing the claim) but I felt I couldn't just roll over and let them keep my money without a fight.
Good luck!0 -
Any news from anyone today. Still no reply from Fatcat on the new Fair Use Policy and Clode have not responded yet to my claim (goes without saying that Redten have not responded).0
