    Hello Essex,

Without comprising your confidentiality clause what would you recommend as the best course of action for people? I signed up in November last year so have the choice of FOS or Small Claims.

    Jamie,

The best course of action is a small claims court case.
It will cost approx. £44 to lodge it at local sheriff court or county court in england.

Will be dealt with within 6 weeks max.

The FOS is free but can take up to 6 months to resolve.

Court clerk will help with writing nd formulating claim though am sure anyone you write to privately through pm will assist if necessary.

    best wishes

I got my phone call. Just have to find the £300 to pay off Clode. I'm sorry if some of you think I'm giving in. I just thought it was a fair offer given I signed up for a pc and broadband package, not the free pc you early birds went in for. The deal is time limited though and I have to pay up by next Tuesday (17th June). Who knows why?

Roll on the MAC and off to a new broadband company, O2 and Be look the most likely at the moment.

make sure your mac is issued as part of the deal --if you pay tiuesday --mac should be issued tuesday.

    regards

    Hello Hamish72,

Clode originally wanted £526.64. I was paying £29 a month though and only started last November. I have two reasonably nice laptops and so I won't begrudge the £300 payment. As part of my offer I did point out that I am taking on the risk of increased broadband costs and also the cost of extended warranty for the laptops. Toshiba charge £79 per laptop for this.

Wish it were FC not I, I paid Monday, was told a couple of days for the MAC and speed increased , still on reduced speed and no MAC!! Have phoned Louise twice today and in her favour she has phoned me back, she says that the request has been passed to redten in both a fax and by email and I am to phone her back if no increase in speed by mid morning tomorrow. We shall see.

I am seriously looking at asking for my money back and resuming legal action, as this is now beyond a joke. 20Kb/s speed is not broadband!!! In fact is is not dial up

I am thinking of going down the court action route but I have heard some of you talking about a "deadlock" letter. Has everyone who has issued court papers had one of these?

    Thanks

No I didn't get a deadlock letter and still took them to court. It's not a necessity.

I also got a deadlock letter, one line from Nick Davies but once again never used it.

More importantly I have at last received a MAC code, only took around 50 working days, it is amazing what can happen if you pay money!!

Anyway hopefully OFCOM will sort that out in the fullness of time, as it is I am free at last, account closed, Mac received and service (I use the term in it's loosest sense) finishes 22nd June.

Will be hanging around the forum to annoy everyone, I think a couple of pints may be the order of the day tonight. :j :T :j
