I am waiting for money claim website to open again to lodge my claim. Guys, as I understand I claim my account balance + 3 months so far and if I win I just use these money to pay off the same balance and close the account with clode?
Thats what I did.
Total cost remaining from date of breach of contract. ( an order to cancel account is more awkward )
Cost entailed in pursuing claim --letters, phone calls etc. --( need the evidence for this cost. )
Cost of lodging and pursuing it in court.
Any additional costs and if you can bring the total to above £500 then you are entitled to up to £150 expenses in going to court to lodge or legal advice or attending court if defended.
plus 8% interest on the total until Clode settle or court order is issued.
If the total cost is less than £500, you cannot claim attending expenses at court or the travel involved etc. if it is defended; but then neither can they.
Make sure any claim is lodged at your own local court where you live and not in Clode/redten area. Consumer claims allow this.

Small claims court claims are very expensive to defend which is why I think Clode are paying up, it will cost them more to defend than to pay out.
I paid too much to escape I think, but the thought of another month or so pratting about with these gentlemen of dubious parentage, was just not worth it too me, I want rid once and for all, and I can assure you there is no way on Gods earth that I will ever touch or recommend any company with affiliations to Redten/Savastore/ Clode/NJP or Murphx, in fact it is almost tempting to start a forum for the poor suckers in NJP, as their service sucks, but at least they do answer their phones.

Remember we who lodged claim at court appear to have done better but really nearly even stevens --we had to pay to lodge it at court so when you consider that, not all that much in it.
At least you got free and thats the main thing and not now paying any more for an abysmal service. :j

Not quite free yet as I am still awaiting a MAC code, now that seems familiar, and I really don't mind what deals others get, the better the deal the happier I am for them, as I say I shall just be happy to see the back of them.
As far as service goes I don't have one at all 25kb/s is not a service !!!
My one hope now is they have some serious dealings with OFCOM and the FSO.

Congratulations to all those who have succeeded in getting out.
I, like many others I am sure, have ben following the forum from day one and occasionally dipping my toes in. It has been a great source of support to all those who have been floundering against the system. Court papers are next on my agenda - been without any sort of service since March. It is just so great to see some success coming at last from the persistance and determination many have over showed these last few weeks.
Well done all of you!!

It seems Clode have decided to become much more flexible since the first few court papers were issued, well done and thank you to all of you who pushed them.
I sent them an email yesterday giving them seven days (Again!) and they got back to me accepting my offer. I signed up last November for the two laptop deal so have given them a fair offer for the two second hand laptops. I should get a phone call today to sort out all the details, fingers crossed.
I would hold on to your court costs for now and push Clode again! Looks like it may have worked for me.:j0 -
I got my phone call. Just have to find the £300 to pay off Clode. I'm sorry if some of you think I'm giving in. I just thought it was a fair offer given I signed up for a pc and broadband package, not the free pc you early birds went in for. The deal is time limited though and I have to pay up by next Tuesday (17th June). Who knows why?
Roll on the MAC and off to a new broadband company, O2 and Be look the most likely at the moment.0 -
