Good luck with your deal, but it seems like the school bully has returned your pocket money ,only to threaten you with another bl00dy nose should you tell anyone the full story. I suppose both sides claim a victory in this manner, but then again redten/clode are dictating things here and you've merely succumbed to their threats/bribe, which is a real shame.
Perhaps you should consider the wording of your deal and see if it prevents you from returning all the user generated content on your site back to the owners for republishing elsewhere.
Don't fall into the trap of the last user to sign a deal who then compromised himself fully by becoming the unofficial mouthpiece of redten.0 -
Seriously folks, what would you have done given the option? I know I would have taken a way out - gagging clause or not.
Luckily some of us have saved the content and will look to repost the Deadten info in some form or other.

Your comments are unfair on Essex, he and the Deadten site have been major players in our fight for what is right, we would all have accepted his offer gagging clause or not, given the chance, as Nedmundo says the info is out there and I am sure will be reposted, I am also sure that if you PM Essex he will supply whatever help you require, without breaking his agreement, and therein lies the difference between Essex and Redten/Clode, Essex is a man of principle.
Don't slag off the helpers, or the help may just disappear.

Those comments were a fair assumption to make without knowing the full details of any confidentiality clause.
If anyone was going to 'lead' a public effort to gain justice, then I'd expect them to take it to the very end. However in answer to your question, I'd not settle for anything less than a termination of contract with no balance outstanding. I'd be even more determined to see this through to the end If I used public support to drive/assist the cause.
At the end of the day I didn't set up a website so my response remains hypothetical.
I respect anyones decision to leave asap, I'm merely reflecting on the fact that this shower still seem to have the upper hand. A case going though to conclusion could have sorted this out once and for all in terms of liability. Even if it went against the customer, focus could then have remained on improvment of service, etc....
At the end of the day I agree customers have been treated with contempt and can understand the reasons for 'jumping ship' asap.0 -

I think the focus should stay on Redten/Clode, etc and not on the indiviudals in this forum. I for one applaud all Essex has done and wish everyone the best in their chosen paths to be released.
I myself have paid £30 to be released and am now enjoying 10mb downloads unlimited from O2 and havent had one drop out since being with them which is the 1st time I have had that luxury since joining Redten (including BT and NJP).0 -

The idea of returning the material posted by others on his site is good and I see no way Clode could know if he did.
No one can be sure how they would react if offered a similar deal and I think that the vast majotiry of us would Deal rather than NO Deal

Hello Essex,
Without comprising your confidentiality clause what would you recommend as the best course of action for people? I signed up in November last year so have the choice of FOS or Small Claims.
