Nel/Jaypee, have you contacted whoever (Redten (laugh), Clode, NJP) to find out why you are throttled like that?

    Dear Member

You have used a considerable amount of bandwidth this month already and
from our records have not taken advantage of our bolt-on's available. We
have speed restricted your account in case your account has been
compromised and are not aware of this. We would like you to give us a call
at your convenience so we can discuss some different options with you.

    Kind Regards

Tel number is NJP and John customer services "manager" claimed I was throttled in at Redtens request. Most likely for using 22Gb in May.

As a point of interest, when I spoke to OFCOM about the throttling in of my service at 5Gb they told me that their investigation into Redten was ongoing and that Redten were still active.

Active at what I wouldn't even hazard a guess at, but active none the less.

    Jaypee,

Those comments were a fair assumption to make without knowing the full details of any confidentiality clause.

If anyone was going to 'lead' a public effort to gain justice, then I'd expect them to take it to the very end. However in answer to your question, I'd not settle for anything less than a termination of contract with no balance outstanding. I'd be even more determined to see this through to the end If I used public support to drive/assist the cause.

At the end of the day I didn't set up a website so my response remains hypothetical.

I respect anyones decision to leave asap, I'm merely reflecting on the fact that this shower still seem to have the upper hand. A case going though to conclusion could have sorted this out once and for all in terms of liability. Even if it went against the customer, focus could then have remained on improvment of service, etc....

At the end of the day I agree customers have been treated with contempt and can understand the reasons for 'jumping ship' asap.

I don't believe they got the better of me, I came out of the deal with pretty much exactly what I asked for except for one small compromise (think you can guess what that was, but watch this space on that one)
I didn't set up the website to " 'lead' a public effort to gain justice" I done it to bring together all the info that was on this forum and make it easier to find.

My court case was made out in the name of Clode Retail Finance, Clodes arguement was that the argreement was to Clode Funding, to get the name changed would of cost 40 pounds. Without going into details of my settlement if I'd taken this route I would of been 100 pound down on where I am now. And would of have at least another month of all this hassle.

Opps did I forget to mention their's a copy of the deadten site on .co.uk and not .com

    :rotfl: :rotfl:
  • Essex,

    Thanks for the update.

Out of curiosity, would you have continued your case if you had named the correct Clode division ?

    Cheers.

I cant speak for essex but personally I still wouldve ended my action with the settlement offer I had.

At the end of the day the action was because I wanted out. For them to offer me a way out and me not take it probably wouldnt have looked the best in court. You can see the judge scratching his head thinking why this has come to court when the settlement had been offered already!?

Purely selfish but probably not, Don't see what extra I could of gained.
  • Hi All,I have been released from my Clode Contract and feel that I should help the rest. I as many others have sent many letters stating the obsvious facts. All to get no-where.However after issuing courts papers with Clode Retail Finance and Clode Funding Ltd as defendents, I was sent a letter saying they would let me out of contract. I agreed and within a couple of days had a letter stating that the account was closed with no penaties and my MAC code attached.Keep up the fight and take them to court. You now have a number of people that have settled out of court so this should help prove your case in a worst case situation of going to court.GOOD LUCK

I agree gnipper, if the courts think you have been unreasonable, they will nearly always find for the one who appears the most reasonable, and if you have been offered all or even most of what you asked for, then you would have a job in court to go further, the Judge would just consider you wasting the courts time.

I am sure my offer was not as good as yours, but hey it was worth every penny to be shot of Redten.

Finally nice one Essex, that rates about a 5/5 on the sneak o meter are you sure you don't work for Redten or Clode? :rotfl: :rotfl: :rotfl:
