I think you are wrong
1. When redten caused BT to withdraw service they broke your contract by failing to supply unlimited broadband service to you. Consumer protection and credit law states at that point you were entitled to a refund of the whole of the monies you had paid for the service.
2. There is sufficient evidence available that they also broke consumer law by failing in their duty of care in providing the service. There is sufficient evidence to show that they were aware in August 2007 that they would not be able to continue to supply unlimited service as they contracted with you.
3. Redten and Clode as jointly liable have consistantly failed since 10.3.2008 to provide the serviceas outlined in your original contract. You are therefore entitled to deduce from this that they are either unwilling or unable to fulfill their end of the contract.
4. Redten, aided by Clode have made themselves unavailable to address their breach of contract and the law states that omissions of commercial companies are as damming as actual acts. There is more than sufficient evidence through OFCOM and the Trading Standards Office ( and now at the OFT at BERR to support those omissions. )
5. 3 months is more than sufficient time to give both these companies the opportunity to address THEIR breach of contract and as such you are entitled to seek the return of all your monies and go elsewhere. They then become liable for any additional cost of obtaining that supply.
6. If you receive the return of the whole monies of the contract, they are entitled to have the PC back which was given free as part of the overall contract.
&. By consumer credit law, you are entitled to hold onto the PC and now any further payments until such times as they return all monies to you.
9. As a settlement alternative you are entitled to the return of the whole monies ( approx £700 ) minus the ACTUAL worth of the PC which new was £300 and second hand is £150. This can only be with your agreement or suggestion.
10. If they force you to go to court you are entitled to the additional costs of going to court, the whole of the monies of the contract or IF YOU CHOOSE, the remaining payments still to be made, plus any additional costs you have encountered in getting an alternative supplier. That is the cost of broadband service at an unlimited level at speeds of up to 8Mbps plus the costs of maintenance of the PC which was also part of the contract plus up to £150 expenses when your claim is over £500 for everything else.

My other connection at work was with Tiscali. Two months after migrating find I'm still being charged. Had to change ISP because of consistant overcharges, customer services can never understand it - think I got 1 credit out of three promised. Have been promised a cheque this time "within 28 days" 0871 phone number means cost of calls wipes out most of any credits promised. I've been "Escalated" so many times over last eight months I've lost count. Nothing ever gets resolved.
Emails usually take a week or so to answer, usually want more information as only gave broadband number, name, address, postcode - need their 16 digit account number. Usually long queue on 0871 number, lots of options and messages then key in your phone number - first question when eventually answered is "What is your phone number?"
Speed was good at around 4½ on 2meg service, mac code was quick everything else was crap.0 -

If at any time BT ceases to provide services to us such that we are unable to continue to provide any of the Services, to you, we may immediately terminate our Contract with you. You will be given the option of retaining the PC, with no refund, or cancellation of any finance agreement; or returning the PC and receiving a refund for whole months remaining or cancellation of the credit agreement as applicable.0 -
this would be usefull if this was a legit company that stood by there contract but these dicks just do as they please court is the only way they listen0

This is where I'm sure you will post back and tell me that your information also comes from a lawyer:rotfl: The guy I spoke to did say to get back in touch if they refused my reasonable offer of a settlement however as I assume that would put Clode in a shaky legal position - this may be of some use to others who have had that experience already.
In resopnse to another post about Tiscali earlier - I'm aware that other people have had issues with them but I've had no problems
