    He's not saying that - He says all Clode are liable for is to provide an equivalent service to the one Redten did. By failing to do that I am entitled to ask for them to discount me what I've been paying Tiscali from April to the end of my Redten contract. However, I am still liable for the outstanding balance of my contract (probably around £300). As I said, you can go around the houses on the "free pc" thing but its in the T&Cs - it belongs to Redten until the three years is up.

    I would argue the outstanding balance in that although you are getting a service from Tiscali the true equivalent service is actually a BT Broadband service, after all that's what you signed up for with Redten. The cost of BT's Unlimited broadband service is actually £24.99 a month. This should wipe out any remaining debt.

    I take your point Essex but my Tiscali service is unlimited so how is BT package any different?

    Edit - just done the maths. While the BT price doesn't quite kill the whole debt it does reduce it to a very reasonable £100 or so.

    It may be unlimited but I've heard poor reviews, the usage maybe the same but thats it. after all a Skoda is a car the same as a Rolls Royce, but if I bought a Roller and the dealer delivered a Skoda I would have a right to complain.

    What sort of speed are you getting, are you subject to a restrictive Fair usage policy, what's Tiscali's backbone service like, all of these contribute to an equivalent service

    I'm a pretty heavy downloader and I've had no problems so far. My speedtest results are below. I live 10 miles or so outside Aberdeen far away from any LLU exchanges (I looked at Sky first but they don't cover my area yet). Let's be honest here Redten was harldy Rolls Royce in the first place!

    I moved to BT Option 3 unlimited in theory however it seems from user forums that restrictions apply after 50 Gig under the dreaded Fair Use Policy

    Just noticed Tiscali up speed is twice the BT up whilst down is the same as mine for incredibledisc

    Fair point, looks like you might be doing well with Tiscali, just some other posters on the forum have not had a good experience. if it works for you . :T:T

    I'd be happy with a New Skoda VRS over a Rolls Royce any day :D Where do I sign up???

    I used the Mac code I got from the walled garden. The lawyer had the same opinion - by taking matters into my own hands and doing what they were patently unable to do I've effectively shot myself in the foot - ain't life grand?

    BTW he also says that by stopping your direct debits you are also breaching the contract and letting Clode off again.

    Totally disagree, essex and gnipper put up a fight with the court cases and clode obviously decided it was not worth the hassle so allowed them to settle, hoping that the rest of us will sit back and take whatever they want to throw at us. Well sorry - my DD remains cancelled, if they affect my credit rating I will sue for defamation of character! It's simple give me the service I signed up for, which I was more than happy with or take me to court!!!

    I suggest that everyone cancel their DD's and have your moment in court, then let's see how clode have to deal with preparing hundreds if not thousands of court cases!

    We see these companies on tv every other week - ripping off the consumer, well I still believe there is a justice system out there that protects us.
