I decided to try to settle with Clode one last time before I file court action. But I'm not having much luck getting a sensible solution from them. Maybe I'm the only one who still finds there offers of settlement unacceptable, but after all this time of me chasing them to sort this I am unwilling and unable to pay the extortionate figures they keep presenting me with. I refuse to be left out of pocket because of the inadequacies of these companies to handle complaints in a sensible and timely manner. And refuse to let them get away with so many breaches of consumer law. The matter is now in the hands of the Legal advice team from my home insurance company. Court proceedings will be filed very shortly.
Don't mess about with solicitors, they are almost as slow as Redten getting back to you, ( I made that mistake and I still hadn't filed court papers when Essex and FC not I were settling ok I have settled too, I think when Clode realised I was serious about litigation, but I don't think I got as good a deal as they did) you have all the info you need on Deadten and if you need any extra info it is available on the forum.
It seems you only get a sensible offer when they know you are serious about litigation, and they know it will cost them more to fight than to settle.
Stick to your guns and you should get a half decent offer.
Still stuck with a cr*p speed at the moment though, 26 kb/s, in spite of being promised a restoration of full speed whilst migrating!

File a claim online at the moneyclaim website make it out with Clode Funding Limited as the defendant, claim for the full balance of your account plus the last 3 months payments for substandard service and any costs of phone calls letters etc.
The court fees will automatically be added on to the claim, depending on how much you claim the fees vary about £40-£60

Even then will come the start of trying to get a refund from Redten which really will be a laugh :rotfl: Ho Hum!
I regret to say that all Mac code requests do indeed seem to go through Redten (or I suspect NJP masquerading as Redten) as after my settlement with Clode on Monday, I expected the speed restriction to be lifted Tuesday, when I spoke to Louise at Clode on Tuesday she seemed genuinely surprised that nothing had happened and said she had put through the request, but would check what was happening and call me back.
She was true to her word and did call me back about an hour later, to inform me she could not get hold of the person she needed to speak to, but had sent both an email and a fax, reiterating the request, and if nothing had happened bu mid morning yesterday to call her back.
Needless to say nothing had happened and when I called her back she said she would try again. This morning (Thursday) I received the following email from Redten/NJP:
From: contactus@redten.co.uk
Date: 06/12/08 08:59:55
To: Jack.parkinson1@redten.net
Subject: Account Scheduled for Closure
Further to your request your account has been scheduled for closure on 22/6/2008 at 23:30hrs.
Regards Redten Internet Customer Support
Tel: 0871 424 0185
I phoned NJP's number to ask for the speed upgrade, and Mac code, only to be told once again to get on the merry go round and to contact Redten on the 0905 number, to repeat my reply here, would add nothing constructive to the narrative but was basically I should cocoa. Phoned Louise back and she informed me she had just received the MAC code and would forward it in an email to me, which bless her cotton pickin little socks she did about half an hour later.
The upshot of this tale is that I don't think Clode have control of any of the technical side of things and are dependent on the muppets at NJP, as John (customer services manager) at NJP / Redten internet support, admitted that he had a request for a Mac code but was unable to give it to me and I would have to speak to Redten on the 0905 number. Sound familiar?
Sorry this has been a bit long winded but it may cast a little light on the way things are happening, namely one set of di**heads, are also having problems with the other set of di**heads, and if that is indeed the case what chance have we poor punters, of getting any joy out of RT?
The good news is that mummy will now let me play with little objects that are not too sharp, and as long as she is watching. LOL0 -
Still no MAC Code but no longer download @26K but this it has gone back to0

nel - have you started court action yet?0

right, but you could still sue to due breach of contract - i.e. not providing the contracted service and claim for balance of account?0
