    Essex,

    A quick reply to your dilemma about taking to court the wrong company.
    I did the same thing (not Clode, an entirely different case) and their defense was the same.
    So I amended my claim. I think it cost me £30 or £50 to amend the claim, I cannot exactly remember. I did this via the on-line claim facility. You may have done the same. But if you've claimed at your nearest Magistrates Court you should be able to do the same.

    Ring the court or use you home insurance legal team if you have it to seek advise.

    I think that you should be aware that if you persist in this claim unamended you may fail if/when it gets to court.

    By the way, try to insist that the hearing takes place at a Court near you, not Cardiff.

    Good luck.
    Thanks for the advise, like qnipper says the forms are very unfriendly. I'll look into this though and get back to you ASAP.

    Just come off the phone after talking to Customer relations at Clode.

    There will be letters going out on monday and "normal" unlimited service would be resumed. She wouldn't go into detail on the phone, she just kept saying the letter would explain it all.

    I'm waiting for the letter and if it's not good news, then I am going to stop my payments and let them chase me.

    Interesting it still Clode, who are just a Finance Company, sending letters out about broadband service from Redten. What about those customers like myself who have nothing to do with Clode, who therefore will not (at least should not) have our details. Presumably we still sit in ignorance! Still the same old shambles.:confused:

    Some breaking news about NJP Services which has shown up on the ISPreview website.

    NJP Services and Breathe Networks Limited will merge and Fast4 has been purchased for a undisclosed amount as part of Breathe's deal. It's unknown where Redten stands in regard to this deal.

    Have Just got off the phone to Clode following NJP's standard letter concerning bandwidth usage, have just passed 5gb, and have been speed restricted to sub dial up speeds, 19kb/s download and 5kb/s upload, and it would appear that I haven't taken advantage of their bolt ons. They have until tomorrow evening to reinstate full speed or I am having another line run into the house and I shall add that onto my claim, it will also stop the problem getting a Mac code out of them, but they are now without any doubt (not that there ever was any doubt) deliberately breaching our contract by making the service totally unusable. Before I was annoyed at their antics, now I am P*****d off, in fact that is even underestimating it. The good news for you all is that it looks as though I may be quiet for a while on the forum, but I am still around, also it may require me to cancel my contract with BT in which case I will lose my landline and dial up as well, mobile internet use will be the order of the day, if that becomes necessary I shall add those charges to my claim as well. C U around

    all contracts must be void now redten have clearly stopped trading they dont answer phones respond to emails or cant sign for recorded letters and they are not accepting new customers bt told every1 the truth on the 10th of march clode obviosly thought they could pass on redtens customers to njp to try and ease the blow but remember your internet provider is redten not clode and not njp redten have stopped trading so your contract is void when clode have there own internet company fatassinternet it should be a new contract and your choice to agree to it

    If the Claim has been issued in the small claims court i.e under £5,000 fixed costs apply.If you have issued against the wrong party they can apply to strike the action and ask for costs.You could attempt to agree to discontinue by consent with the Defendant with no order as to costs.Why does everybody not consider a multi party action against Redten or Clode, i.e all group together instruct one firm of solicitors for a test case and the funding of that firm split pro rata between everybody.This will then enable all the issues to be addressed and not repeated thus minimising legal costs and court time for the economics of the case?

    Just got a copy of Clode's defense in my court case against them, as predicted they are saying it is not a Clode Retail Finance Limited issue.
    ====================
    The defendant is not party to the loan agreement (contract) to which the claimant refers. The loan agreement is between the claimant and Clode Funding Ltd which is a seperate legal entity. The defendant named in this action is contracted to provide customer service support to Clode Funding Limited however is in no way party to the contractual arrangements of the loan agreement in question. The defendant has previously written directly to the claimant to explain this point.
    =========================

    Just considering what my options are at the moment.
    Think they are either
    1. Continue with the current action and ask the court to make the decision if CRFL or CFL are responsible.
    2. Start a new action against CFL

    Not sure what the impact is if I take option 1. and court decides CRFL are not liable, will I get hit by costs etc.
    Any legal eagles out there that can help.
