    Still at it I see guys? Good on you.

    Just got a returned to sender letter this morning from Redten stating "the recipient has 'gone away'" don't we all wish!! That was from a letter I sent back in March when all this debacle started.

    Anyway, news on my front. I've now cancelled my direct debit as I cannot afford to pay 2 broadband companies. But still haven't heard anything apart from the standard letter reply from Clown. Sent another letter last week informing them of my intentions to cancel the direct debit due to them cutting my broadband, not me.

    Anyone gone through court action yet? I remember reading a couple of posts millions of pages back that some dates were 6th June or something?

    Why can't these bloody !!!!!!s let us poor souls off? It's dispicable that this is STILL going on, 3 months later. Absolutely dispicable.

    See my post at the top of this page about legal action. Will up date the deadten site as well but that will have to wait till tomorrow now,

    I've considered that, but check their T&Cs. As I paid in full for 3 years Deadten I'm reluctant to transfer to NJP, actually on capped then, and have to pay another £46 to cancel immediately, because they effectively charge for 2 months + 28 days notice if you cancel - yet another fiddle in the small print!.

    At the moment my service is remaining uncapped and generally about 5Mbps download speeds so I'll stick with it until things get worse or settle so I can get a MAC.

    Really sorry for those that are suffering worse than me, although I'm not confident I'll get any money back from my £700, but at least I've had a year unlimited broadband and an adequate PC, so just an average sucker I guess.

    Still, all will be sweetness and light when fatcatinternetb******s takes over and give unlimited, with wonderful instant free support! Must go now cos I must get a photo of the Pig that's just flown past the window!!:rotfl:

    Just considering what my options are at the moment.
    Think they are either
    1. Continue with the current action and ask the court to make the decision if CRFL or CFL are responsible.
    2. Start a new action against CFL

    Not sure what the impact is if I take option 1. and court decides CRFL are not liable, will I get hit by costs etc.
    Any legal eagles out there that can help.

    You can add Clode Funding to the claim --it will delay it but not as much as filing a new claim. It will cost less to add a defender than filing a new claim.
    Dont think Sherrif will wear their defense at the end of the day.

    My original papers from V12/Clode Retail Finance thanked me for taking out a loan with them even though the actual agreement referred to Clode Funding providing the money. If they claim that Clode Funding is solely reliable then Clode Funding have breached the Finacial services Act and the Consumer Credit Act as they were supposed to write directly to you before the end of the first year showing the detail of your payments and the amount outstanding. When I asked for this as it had not been done. I received a print out from Clode Retail Finance not Clode Funding.
    Attempting to deceive is not something the courts look kindly on.
    Both companies are owned by the same man if you discount the mortgages held by the banks. Dropping a wee letter to the banks may not go amiss if they continue to play silly b............

    Also in their registration with the Financial Services Ombudsman, Clode Retail Finance are registered as the principle company and the others as agents .

    Also if you also look at the " formal notification of the terms and conditions of your loan " it came from Clode Retail Finance ---they wrote this to comply with the financial services act as being responsible for the loan.

    On the 21.5.2008 on the Financial Services Authority web site of registered finance companies, Clode Funding did not have any appointed representatives or tied agents.

    I have all these screen prints if necessary.

    The danger with that is if they decide to play silly bu**ers, you have just jumped out of the frying pan into the fire, I do not trust any of them, Murphx, NJP, Clode or the inimitable Redten, I am also uncertain how the legal situation would be affected, good luck to you though should you wish to chance it.

    Hi All, still follow this thread everyday even though I jumped ship from day one. Paid clode for a couple of months - but then cancelled DD. Had a letter the other day about missed payment and replied as below:

    Red10 – Web V12 IFF 36 Month
    Acc. No. 538734
    Balance: 451.78
    Arrears: 19.99

    WITHOUT PREJUDICE

    Dear Mr Symons,

    With reference to your letter dated 27/05/2008 regarding payment for the above, you will see below a communication I sent to Mr Nick Davies warning of non payment until the broadband service I signed up for was restored to a satisfactory level that I had before the 10th March 2008. I have been following the articles on Moneysavingexpert.com with regards to everything that has happened and the various other customers – some of whom are taking court action against your company or one of your companies? Until you can assure me of a date, when the service will be restored as per our contract then you leave me no choice but to withold payment. I, unlike others am not going to waste my time taking you to court – I shall let yourselves, spend YOUR time in pursuing me and would look forward to have my say in court.

    I await your response.

    I got out on day one and have been waiting for clown to come back to me with an acceptable solution ,well its been 2 months since they were warned of my predicament so im doing the same as you Andy,,,screw em i'm cancelling my DD tomorrow and they can chase me ,i dont give a crap about my credit rating.:mad: :mad: :mad:

    A quick reply to your dilemma about taking to court the wrong company.
    I did the same thing (not Clode, an entirely different case) and their defense was the same.
    So I amended my claim. I think it cost me £30 or £50 to amend the claim, I cannot exactly remember. I did this via the on-line claim facility. You may have done the same. But if you've claimed at your nearest Magistrates Court you should be able to do the same.

    Ring the court or use you home insurance legal team if you have it to seek advise.

    I think that you should be aware that if you persist in this claim unamended you may fail if/when it gets to court.

    By the way, try to insist that the hearing takes place at a Court near you, not Cardiff.

    I looked into amending the defendent @ re-serving, however the forms I had to complete were a little un-user friendly to say the least - can you amend online then?

    I think you change the court location if and when it comes to a hearing.
