If we are entitled to a refund of all payments - would that then be CLODE to pay us back (as they are probably insured to cover this).

Just got a letter from Clode regarding my Claim against them, they are arguing the fact that I have issued the papers against Clode Retail Finance Ltd, they state that my loan agreement is not with Clode Retail Finance Ltd but Clode Funding Ltd, and that Clode Retail Finance Ltd is not party to the agreement, they suggest I close the claim and start a new one against Clode Funding Ltd. Strange this as every bit of communication I have including this letter all comes from Clode Retail Finance Ltd. Is this a real technical loophole, or are they just stalling for time.

The mind boggles at the duplicity of these people I expect the agreement is full of little booby traps like that but as said Clode Retail have held the reigns and cracked the whip from day one and even negotiated the mac's for settled accounts from Redten so I don't think that will wash.

Be interesting to see what they come up with next and "come up " is the correct term from their level up is the only direction
    Who cares ??

Just go with the two pronged attack, and raise cases against both companies.
Does anyone know if the registered office is the same for both Clode companies?

Just for information to the people who have payed up and recieved their MAC from Clode....You need to have your new ISP accept and process your order before the line is cancelled. Otherwise you may have issues getting it re-connected, if unsure just speak with your chosen provider. O2 have just confirmed this with me now as my proposed start date with O2 is the day after NJP turn my internet off!!

Just checked my original letters, and guess what even though the agreement is with Clode Funding Ltd. The bottom of the page says Clode Retail Finance, and the covering letter with the original order came from Clode Retail Finance ltd. Think this is definitely a stalling exercise. which I am not going to fall for.

Dont rush into anything check companies house and the FSA register.

If they are now saying that the contact details for the geographic firm to whom you are complaining is fdifferent from the contact details they issued --they have just broken company law.

They were obliged to inform you of the correct name, geopgraphic location and contact details for an official complaint.

Clode retailfinace ltd are a principle of Clode Funding and are registered separately with the FSA.

I formerly requested a printout of my account for pursuant purposes and was given that I held my account with
    clode Retail Finance Limited
    Units 19/20
    Neptune Court
    Vanguard Way
    CARDIFF
Limited generally means a separate company ....as it is a type of company. I would seek advice from company house.
Company House have them listed as a separate company and their details do not match the details that have been lodged with the FSA so would give them a telephone call and also to Trading Standards on their attempts to mislead and evade the regulations.
Should they respond that way to mine, then thats what I will do.
Ask the court, printing off the various papers, to amend your claim to include all references to other names recorded for these companies.

Clode Funding Ltd are shown as the tied agents of Clode Retail Finance Ltd. and as Clode Retail were the introducer and arranged the crdit facilities and paid it to redten, they are the ones liable in my mind so ask the court to include Clode Funding--special form for this --can get it on the web site and put the classification if not Clode Retail then Clode Funding. --same director.

If whoever got a collection letter for cancelling their debit could let us know which company sent it that would help.
