Just got a letter from Clode regarding my Claim against them, they are arguing the fact that I have issued the papers against Clode Retail Finance Ltd, they state that my loan agreement is not with Clode Retail Finance Ltd but Clode Funding Ltd, and that Clode Retail Finance Ltd is not party to the agreement, they suggest I close the claim and start a new one against Clode Funding Ltd. Strange this as every bit of communication I have including this letter all comes from Clode Retail Finance Ltd. Is this a real technical loophole, or are they just stalling for time.

    !!!!!! essex.

I have used exactly the same title on my papers - if they stall like this then I wont be happy and Mr Nick Davies will get both barrels cos that is ANOTHER £30 down the drain!

Unbelievable bunch of ... well. you get the point

If I were you I would argue as you have said, all communication was from Clode Retail finance so what were you to assume?

In actual fact, elaborating this forwards, that means that any communication from CRF was in actual fact irrelevant so we have no information about the Redten mess, and how can they make you an offer to settle the account if they arent party to the agreement?

Just checked my original letters, and guess what even though the agreement is with Clode Funding Ltd. The bottom of the page says Clode Retail Finance, and the covering letter with the original order came from Clode Retail Finance ltd. Think this is definitely a stalling exercise. which I am not going to fall for.

Essex - PM me with your response, we need to be united on this - if they try that on with me then Ill regard all communication received from them as invalid and therefore an offer to settle the agreement as never made.

i know this would cost you more money, but why dont you leave the Clode Retail Finance one open and do a second one for Clode Funding? That way one of them must be right and both still active.

Thats not a bad idea actually Big - contest it and start a new one.

The more I am experiencing in dealing with them the more disgrutned I become - it seems they are above the law and statute and are totally unregulated. Their customer service and customer empathy is very poor and I am amazed that anyone is allowed to act like this, unregulated.

Just tried ringing NJP to query what happens to my line once they cut me off (I've paid Clode off) and I sat there paitently waiting through their annoying on hold music, I went from caller 3 to caller 1, waited about 5 mins as caller 1 to then get a recorded message saying that I have been on hold the maximum amount of time and that i should ring back later but I will be treated as a priority caller...am currently on hold as caller 3...we shall see!!
Anyone else had this with NJP?

Just phoned again and exactly the same response, me thinks this is an unmanned phone line...........

    Essex,

Just looked at the letter regarding the offer to cancel for a fee and it says that only they (Clode Retail Finance) can cancel the agreement. Also the cheques were to be made out to Clode Retail Finance. Looks like they made themselves party to the matter.
