LOL they refused me my MAC as I have taken them to court. I have kindly referred them to section 22 of the Ofcom regulations. One point of which states:

My initial thought was to reply and say "oh, thats alright then, if you arent regulated then you dont have to do the right thing" but left it as they confirmed they had replied to my court papers with their defence. Be interesting to see what that defence is.
Getting really stressed about this whole situation again now. Why wont anybody do the right thing. I already promised I would keep paying till the courts resolved this issue.
I can hand on heart say i would never deal with Clode again on any matter - nor would I advise anyone I know to do the same0 -

I have just asked Louise at Clode for my MAC code and she stated that only those who had settled their account with Redten and Clode could have them, like you I pointed out that my dispute over our contract was a separate issue to my request for a mac code, and got the same recorded message, only supplied to those who pay for them.
Like you say it will be interesting to see what their defence is.
I also spoke with NJP and asked the question what is their relationship with fast4 and was told that they just supply a service to them as they do with redten, when I pressed on how they could migrate us to another supplier of their choice but could not supply a MAC code I was told that they could inform redten that they had moved one of their customers at the customers request, where I promptly asked him to supply me with my mac and inform redten that they had done so at the customers request. Guess what back on the merry go round.
I also spoke with Redten on their premium rate line and was advised that I must contact [EMAIL="mac@redteninternet.net"]mac@redteninternet.net[/EMAIL], as if that hasn't been tried. Though I must admit [EMAIL="mac@redinternet.net"]mac@redinternet.net[/EMAIL] is different to the [EMAIL="mac@redinternet.com"]mac@redinternet.com[/EMAIL] that I have been using. Will give it a spin.
That was good [EMAIL="mac@redinternet.net"]mac@redinternet.net[/EMAIL] bounced, so they cannot even give the correct details on a premium line, still he did promise he would pass on my details to the disconnections department and they would contact me within 72 hours!!! Yeah right, still would they lie to us?

Problem there is that regulation applies to Redten not Clode who are a finance company not an Isp its obvious they can get the MAC's from Redten probably by saying as your account is closed and that Redten then has no liability to Clode in respect of your account.Who cares ??0 -

I think we all second the last comment, sharks come to mind they have had my hard earned cash and will never get another penny of me as long as I live, if I ever see another finance agreement with the words clode or V12, I will walk away and do without. Even the word red!!! now sends a shiver down my spine now. Chins up it cant be much longer now before something has to give.0 -

They are now getting them from NJP, of that I am sure. Thats why people should now be requesting code from NJP/Fast4 and if they dont get it report them to OFCOM.
The only way to stop these people is to report them time and again until it is stopped and they have been fined. OFCOM is actually now mad that they do not have stronger and quicker powers but they are dogged.
Clode are only releasing people because the money they are paying them does not cover the 15Mb cost which they need to pay to NJP. I think Clode are paying for the broadband and redten were paying for the computers; thats why Clode are not worried bout the computers; its leaving redten to chase that if they wish and as they are only worth about 150 now at most they do not seem to be bothering. Clearly they are heading somewhere's else.

Just because they provide loans does not mean they cannot be regarded as providing broadband supplies.
You cannot get them for not providing a mac but you can get them for providing BB and failing to register with OFCOM as a BB supplier. Try get NJP to email you that Clode is to issue you the codes. Also try to get one of the others that have been issued a code by Clode to copy you their letter.
You can of course report both of them to Trading standards for unfair business practice which breaches consumer protection, which certainly will make them take notice; now new law in -- you still have to take them to court for the money contract but it should get you your code. NJP and Clode have no right under law to collude in denying you consumer protection.0 -

This is where I'm up to in my case against Clode
They have completed an Acknowledgement of service.
Which means
Acknowledgment of Service
If the defendant does not admit the whole claim the defendant should file a response to the claim within 14 days of service of the claim. However, if he needs more time than this filing an Acknowledgement of Service extends this total time for filing a response to 28 days from the date of service.
Filing of an acknowledgement of service might also be used to tell the court that the defendant intends to contest the court's jurisdiction. This means that the defendant believes that the court does not have legal authority to hear the claim that has been made against him. Jurisdiction in this context does not refer to geographical location, for example - if the defendant lives in London and the claim was issued through Northampton, this cannot be considered as grounds to contest the court's jurisdiction.
The defendant can complete and submit an acknowledgement of service online or by filling out the acknowledgement of service form in the claim pack and faxing or posting it to the court. The court will notify you if the defendant files an acknowledgement of service and what happens next.
After this:-
If the defendant disputes the full amount of the claim, he will complete a defence. The defendant can complete and submit the defence online, or by filling out the defence form in the claim pack and sending it by post or fax to the court.
The defendant should complete and submit his defence within 14 days of the date of service of the claim, unless an acknowledgement of service was filed, in which case he should respond within 28 days from the date of service.
The defendant must state which allegations in the claim he denies and the reasons for doing so. If he fails to deny an allegation it may be taken that he admits it.
Before submitting a defence the defendant will be required to complete a statement of truth.
If the defendant files a defence and the defendant is an individual, the case will be transferred to the defendant´s home court. Where the defendant is not an individual (ie: the defendant is a business), the case will be transferred to your or your representative´s home court. This means that your claim will no longer be handled by the MCOL system.
MCOL will send you a Notice of Transfer, an allocation questionnaire, and where the amount claimed exceeds £1,500 a request for the allocation questionnaire fee. The allocation questionnaire will help the judge decide how the case should proceed. Most claims for £5,000 or less are dealt with in what is called the ´small claims track´. Claims of more than £5,000 are generally dealt with differently, either in the ´fast track´ or ´multi track´.
So Clode hope your going to enjoy the trip from Cardiff to Essex. can't wait to meet them in Court now, they have had more than enough chances to end this and haven't made the slightest attempt to resolve a thing. I have given them every opportunity to make a settlement and they have refused.
I'll let you all know what they come up with as their defence as and when I get to see it.
