    Some Facts from the Courts I got Posted today.

    If you Earn Less than 12K a year the court will wave the fee for litigation for a single person.

    If your in reciept of Income support, Job seekers allowance, or Working tax credit you may not have to pay. Google EX160 and download and print off a copy of the form Application for fee remission.

    I hope this helps those who may not be able to afford court fees and this factor stops them from using the small claims court.

    If in Doubt seach for your local court and ask to speak with an advisor in the small claims court to see if your able to claim a remission.

    But you've breached your contract. If you didn't your in a better state if you need to take it to court.

    I would send them a Letter/email stating the following

    I'm withholding monies inline with the Consumer Credit Act of 1974 for the breach of contract and for the failiure of Clode Retail Finance to resolve my complaint regarding the Quality of service I recieve from Redten Interent.

    As your Aware I'm paying for something contractually different to which I orginally contracted Redten for. The Consumer Credit Act also holds you jointly and severely liable for the Breach.

    I will withold monies until you rectify my service as your jointly liable under Section 75 of the Consumer Credit Act 1974.

    Please Ensure my Credit File is not affected by this issue.

    dafftbint123 is right, it is not advisable to cancel payments.
    As long as you keep paying the laws on your side if your not getting the goods or services your paying for.

    dafftbint, my situation is a little different, I wasn't transferred to NJP, I have taken legal advise on this and I an fully within the law and my rights to stop paying for something I am clearly not getting. They (RT/Clode) made no attempt to connect me with the new service or contact me about it therefore it's not that I'm being charged for a service which is different to what I agreed, I have no service with them, technically they cut me off for no reason of my doing. According to my legal advise they don't stand any hope whatsoever in making this stand up in court, they broke the contract first.

    I made a complaint to the Advertising Standards Authority re Redten offering unlimited broadband and then changing to a capped limited system without notification. They have just replied stating they've taken it up with Redten as a formal investigations. They probably won't get very far as its looks like they've gone or are about to go bust. Another nail in the coffin though.

    both me and the wife have spoken to a few legal advisor's and they all say the same thing, "stop paying them, they have broke the contract in so many ways they are unlikely to take you to court"

    I also did that but included the Free 24 meg upgrade I have had the same reply but as the ASA,s ultimate weapon seems to be a referral to OFCOM which many of us have done, just dont hold your breath for any action from them even if Redten prove immortal in the business sense ,

    I would like to stop my DD;but I can,t obtain my MAC so i daresn,t take the risk.
    I wait in trepidation every day for 'no connection' back again.
    Throughly demoralising studying online and wondering if I can get connected again..them 10 days in March were the pits!
    I,m a small download user,basically just for OU study..less than 5 GB per mth,but its just the reliability issue.
    I JUST DON,T SEE ANYWAY OUT...either way i lose...
    I would like to move..I would still pay the DD...but this uncertainty about transferring(or even getting my MAC) is causing major 'heartache':( .
    I,m just going to wait it out...My tutor already knows the problems..not that there was too much sympathy coming my way(getting your MAC is NO problem!!!)
