    Just had a new highest offer sent to deadten £526.64 and I thought they were being silly with my offer at £219.80

    Thank you for your offer letter, however I regret that I must reject it as it falls a long way short of reality.

    Failing to provide any information on any of their proposed changes.
    Failing to provide reasonable duty and care in the provision of a service to me.
    Consumer Credit Act 1974 (CCA74)
    75.—(1) If the debtor under a debtor-creditor-supplier agreement falling within
    section 12(b) or (c) has, in relation to a transaction financed by the agreement, any
    claim against the supplier in respect of a misrepresentation or breach of contract, he
    shall have a like claim against the creditor, who, with the supplier, shall accordingly
    be jointly and severally liable to the debtor.
    [FONT=&quot]Definition: Section 75 of the Consumer Credit Act 1974 states that the lender of money for a purchase is jointly responsible with the seller for the purchaser getting the goods or service purchased, or receiving a full refund if they do not receive the goods or service. What this means in practice is that if you paid more than £100 by a UK issued personal credit card (but not a debit or charge card), or borrowed money under a loan agreement regulated by the CCA74 and arranged by the trader, then you can claim ALL the money you paid (irrespective of how you paid it) provided that the maximum contract value does not exceed £30,000, back from the card company or lender if you do not get what you bought.[/FONT]
    To put this into context with regard to the current situation, I purchased 3 years unlimited broadband service with a free PC. I am not getting an unlimited service and therefore, I am not getting the service purchased. It is therefore, unreasonable to expect me to pay to be released from an agreement, when that is your legal obligation anyway.


    This is my first and only offer at a settlement in your favour, and should you reject this offer, you will leave me with no alternative other than to start court proceedings to recover the full amount of my losses, including but not limited to, my time and legal fees in pursuing this matter to a conclusion through the court system.

    Just got a letter today from NJP dated 30 April.
    "We are not however your ISP...and the service agreements you have for your home computer and internet supply are with Redten directly.
    As a result of this, NJPServices is unable to supply you with a MAC code or offer any assistance for your Redten account.
    If you are unable to contact your current ISP to resolve any issues..."
    They then go on to offer me a capped broadband service for £16.95 via Fast4 and a 24MB upgrade for only £47.

    I don't think so.

    Guess what?
    CLODE are sending out emails to a list of people this afternoon. I am appently on this list and will have my offer then. The lady confirmed that both Nicola and Lousie are in the office and on the phone.
    PLEASE CAN EVERYONE GET OFF THE PHONE TO THEM AS ITS GOT TO BE MY TURN NOW. :rotfl:

    Emails saying what? Sorry but we will have to wait another 2 weeks for them to make a decision, but when we do you will only have 2 days?!

    I have had the same offer from NJP this morning and have forwarded it to OFCOM, as I cannot see how they can transfer us to their own service yet not supply us with a MAC code to migrate to another service, I also cc'd my email to clode, njp and to redten.
    It just gets sillier by the day.

    I paid upfront in full by credit card in Nov06 and am following the Trading Standards / credit card route to get my money back.
