    "prior to the 2nd of May" could be that's when they need to pay njp for another month, or they are also facing bancruptcy and trying to cover staff wages?

    I had a few heated email exchanges with Nick - I wonder if he is accessing email from home or something.

    My email communication has been with Nick so I can only assume that is the case (or Blackberry or something).

    Yes for the sake of £30.64, it's a small price to pay to be free, I feel for the people who have been with them longer and have ridicolous offers, who has that kind of money just sat in their bank that they can pay off with couple days notice?

    have just made clode a counter offer, but I'm thinking i my have been a bit over generous, thanks to other posters on this thread, i pinched bits from yours.

    Dear sir or madam

    Thank you for your offer letter, however I regret that I must reject it as it falls a long way short of reality.
    I am proposing that, without prejudice to any future claim that I may make should this offer be rejected, that I pay Clode Retail Finance the sum of £0.01 in full and final settlement of my account Reference: 526789, with no further payment due, and with no adverse effect to my credit rating. Also on the understanding that I receive written confirmation of this agreement, and my MAC code is supplied as soon as possible and certainly within 5 working days.

    the facts behind my offer are
    Redten can no longer supply unlimited broadband and are in clear breach of the contract with myself,
    Failure to give notice of the contract change and its details and allowing me the opportunity to reject it.
    Failure to notify me of your consumer protection rights at the time of the change.
    Providing a lesser and degraded service.
    Instituting a cap and blockage on my broadband connection and access when my contract was for unlimited and uncapped service.
    Failing to provide me with a service for a number of days in the month following their application of a cap on the service.
    Failing to provide any information on any of their proposed changes.
    Failing to provide reasonable duty and care in the provision of a service to me.
    Consumer Credit Act 1974 (CCA74)
    75.—(1) If the debtor under a debtor-creditor-supplier agreement falling within
    section 12(b) or (c) has, in relation to a transaction financed by the agreement, any
    claim against the supplier in respect of a misrepresentation or breach of contract, he
    shall have a like claim against the creditor, who, with the supplier, shall accordingly
    be jointly and severally liable to the debtor.
    [FONT=&quot]Definition: Section 75 of the Consumer Credit Act 1974 states that the lender of money for a purchase is jointly responsible with the seller for the purchaser getting the goods or service purchased, or receiving a full refund if they do not receive the goods or service. What this means in practice is that if you paid more than £100 by a UK issued personal credit card (but not a debit or charge card), or borrowed money under a loan agreement regulated by the CCA74 and arranged by the trader, then you can claim ALL the money you paid (irrespective of how you paid it) provided that the maximum contract value does not exceed £30,000, back from the card company or lender if you do not get what you bought.[/FONT]
    To put this into context with regard to the current situation, I purchased 3 years unlimited broadband service with a free PC. I am not getting an unlimited service and therefore, I am not getting the service purchased. It is therefore, unreasonable to expect me to pay to be released from an agreement, when that is your legal obligation anyway.


    This is my first and only offer at a settlement in your favour, and should you reject this offer, you will leave me with no alternative other than to start court proceedings to recover the full amount of my losses, including but not limited to, my time and legal fees in pursuing this matter to a conclusion through the court system.

    nice one m8 :) but hey if you do have to go to court make shure they pay you back every penny from day one of your contract as stated they have to pay you and think all those that have paid anything to get out have been diddled out of thier legal rights and payments should have been made to them not to clode the offer to walk away penalty free and such is still in clodes favour as then they dont have to pay back every penny spent from start of contract to us :)
