    poor pc for aparently £500. that spec machine could be purchased for £200 or less. but for £19.99 for broadband is not to bad for unlimited downloads, but not the 3 yr deal.

    Just a thought, though I do realise that on here the majority want me to stick my thoughts up my jacksie :p
    Does anyone think that perhaps Clode are offering these deals in order to get something back rather than nothing? By that I mean that if Redten went belly up, Clode would get nothing as there could be NO dispute over us stopping our DDs. However, these deals, and lets face it some are very low at £30 plus, are a way of at least getting SOMETHING back before Redten go. Hence perhaps the ludicrous short time frame to pressurise decisions and payment by tomorrow? Any thoughts?

    Well my answer to that is one of my counter offers I gave them three chioces to choose from!!! is they can have the pc back as they were saying at start of all this we paying for equipment and pay ME back what ive paid allready up to this date in full as the law states I am entitled to a refund for money paid as the contract has been broken by them and hey they getting a good deal there they wont have to pay me back for cost incurred and me keep the pc and they wont even have to pay any of my costs for trying to sort it out now thats the fairest deal they can get !!! they win all the way no? or let me go keep my disfunctioning pc dont pay me or court costs provide me a mac and all is good or the other choice reimburse me the cost I have had to spend on trying to get it sorted supply me all i have not recieved and reinstate my unlimited connection immidiately with no caps or change to fair use policy of start of contract and reimburse me for time on capped limmit and a letter explaining who holds the warranty and such so how is my offer unfair choice of three and all with in my rights as the law states from day of breach in contract !!!.

    I assume you have not received a reply back from Clode? when did you send your counter offer?

    was sent on monday the 28th and no I have recieved no reply as of yet just read reciepts i did send another email today asking for a reply to that email but then i did give five days for it to be sorted and hopefully a final solution to it all as i say ill give em the pc back thats not a problem as long as i get the money i have paid so far back and thats what im entiteled to in law as ive been made aware and that other than court is going to cost them more than letting me walk away clean !!!!

    Well I've just paid my exit fee.

    I feel like a huge weight has been lifted from my shoulders.

    Told that it should be 7 to 10 working days for a MAC which will be issued from Clode either by letter or email.

    I offered them a settlement figure of £19.90 insted of £158.90 my offer was "declined"

    At least I have a deadlock letter. This shows the courts I have made every effort to bring this matter to a close.

    Well I got my written version yesterday and I thought it warranted a bit more sarcasm. So here's my reply - enjoy!

    Sent by recorded delivery and email to Customer Relations, Nicola Dobson & Nick Davies, all of Clode Retail Finance Ltd.

    Dear Sir/Madam,
    Thank you for your letter dated 26/04/08 and received on 30/04/08, in response to mine dated 20/04/08. On reading it, I was disappointed to see that you had decided not to cancel my original agreement without penalty and opted instead for a make a settlement offer of £159.80 payable by myself. Naturally, I must formally decline this offer.
    A ‘rebate’ of £12 per month is not going to cover the cost of an equivalent service (i.e. BT Option 3 at £24.99) to that previously enjoyed under Redten. Furthermore, this blanket ‘rebate’ has been applied to all offers sent out to other Redten customers. This means that those which signed up later than March 2007, paying £12.99 per month are being given a settlement offer in the region of £30, despite the fact that they have and would pay significantly less than myself and other ‘original’ Redten customers. I don’t see how that could be considered fair.
    Since the original breach of contract, 8 weeks have passed. If Redten were capable of providing my broadband connection as per originally advertised, surely they have done so by now. I think they have had more than a reasonable time to so and as stated in my previous letter, it is patently obvious that I will not be getting the service which I originally enjoyed.
    In case you were unaware of the laws under which your industry operates, here is a little excerpt from the Consumer Credit Act 1974, which I’m sure you will agree that it applies to yourselves, along with an explanation of its application in practice:

    [/FONT]
    75.—(1) If the debtor under a debtor-creditor-supplier agreement falling within
    section 12(b) or (c) has, in relation to a transaction financed by the agreement, any
    claim against the supplier in respect of a misrepresentation or breach of contract, he
    shall have a like claim against the creditor, who, with the supplier, shall accordingly
    be jointly and severally liable to the debtor.

    [FONT=&quot]Definition: Section 75 of the Consumer Credit Act 1974 states that the lender of money for a purchase is jointly responsible with the seller for the purchaser getting the goods or service purchased, or receiving a full refund if they do not receive the goods or service. What this means in practice is that if you paid more than £100 by a UK issued personal credit card (but not a debit or charge card), or borrowed money under a loan agreement regulated by the CCA74 and arranged by the trader, then you can claim ALL the money you paid (irrespective of how you paid it) provided that the maximum contract value does not exceed £30,000, back from the card company or lender if you do not get what you bought.[/FONT]

    To put this into context with regard to the current situation, I purchased 3 years unlimited broadband service with a free PC. I am not getting an unlimited service and therefore, I am not getting the service purchased. It is therefore, unreasonable to expect me to pay to be released from an agreement, when that is your legal obligation anyway.

    As a final attempt to reach an amicable conclusion to this situation, you have the following options-

    Within 10 days from receipt of this letter (note a reasonable time period and not what you gave me to accept your offer) you may either:

    1: Prove your stated confidence in Redten’s capability to provide my broadband connection as per original agreement offer by reinstating my unlimited broadband service at an equivalent or better quality to that which I enjoyed prior to the debacle of 10/03/08, including a free upgrade to 24Mb/s service, when it becomes available in my area and without extra cost to me or,

    2: Cancel my agreement with you to provide a direct debit of £19.99 to yourselves for the term remaining and forward me my MAC code. This is to be done with confirmation in writing to myself, without any penalty and without any adverse effect on my credit record.

    Alternatively, if you would like to make a trip to sunny ******** to resolve the issue through the proper legal channels, I would be delighted to meet up with you. Unfortunately, once your time and expenses involved in making such an excursion are taken into account, along with reimbursing my expenses to date, refunding me for the originally ordered service not received and paying court costs, I fear you would find this option financially prohibitive.

    I suggest that this time, you carefully consider my previous correspondence and the above options properly and ensure that you come to a decision which both meets your statutory legal obligations and brings a conclusion which is amicable to both parties. I look forward to hearing from you.

    I sent counter offer to Louise Hingley that was accepted. So have now paid up and am finaly rid of Redten. Also cc'd counter offer to Nick Davis who sent back this morning saying it had been declined. Just rang again and confirmed that my account is now closed. So Nick Davis, you ain't the man.
    Now waiting for mac code so I can get a decent ISP.

    Ps I got out for £102 and had been with Redten since Jan 07.
    Will keep checking the forum to see how you all get on as it seems to have become a bit of an habit
