    My mates just sent me his stats for the month....8.2GB Upload, 36.6GB Download,total 45GB at a total cost of £58 to redten..woo hoo.

    Mr Davies,

    Thank you for your prompt reply.

    I would reiterate that when you do reply that you consider the following points.

    Your email states that a £12 rebate is more than adequate to find a replacement service. A replacement service from BT is £24.99, remember I signed up for Unlimited internet backed by BT, so this is the equivalent replacement service. Therefore the cost for me to retain an unlimited BT backed internet connection for the next 20 months is £499.80.

    This situation is in clearly in violation of the following terms and conditions of my Redten contract.

    "4.1 We will endeavour to ensure that the Service provided under these Terms & Conditions shall be provided using reasonable skill & care."

    Clearly the service I have been provided has not met this particular clause.

    "12.12 Should we increase the Charges or make any Contract modification, which is likely to be of material detriment to you we shall provide you with 14 days written notice and the increase or modification will take effect from the end of that period. If this occurs you may be entitled to terminate your Contract by giving us written notice detailing the proposed modification at any time on providing us with 10 working days notice, such notice to expire before the price increase or detrimental contractual modification takes effect. "

    A capped download limit is clearly of detrimental effect and I received NO written notice. The terms state clearly that if the service is of material detriment to me I am ENTITLED TO TERMINATE MY CONTRACT and I have given the written notice of such. As I wasn’t given the 14 days notice, I was unable to give you 10 days written notice!!!!!!!!!!

    I will remind you of the following section of a piece of legislation which I sure you are familiar with – The Consumer Credit Act

    Under the terms of the Consumer Credit Act you, as providers of credit on behalf of Redten you are jointly liable for their service.

    Consumer Credit Act 1974 (CCA74)

    Section 75 of the Consumer Credit Act 1974 states that the lender of money for a purchase is jointly responsible with the seller for the purchaser getting the goods or service purchased, or receiving a full refund if they do not receive the goods or service. What this means in practice is that if you paid more than £100 by a UK issued personal credit card (but not a debit or charge card), or borrowed money under a loan agreement regulated by the CCA74 and arranged by the trader, then you can claim ALL the money you paid (irrespective of how you paid it) provided that the maximum contract value does not exceed £30,000, back from the card company or lender if you do not get what you bought.

    I have already spent £39.98 on a substandard service over the past 2 months and additional costs in telephone calls to Clode/Redten/NJP to try and resolve this issue.

    I feel that as an innocent consumer I have been treated very poorly in this regard and a large organisation such as yours should be reacting and corresponding with consumers much more efficiently than has been the case.

    This matter has been dragging along for far too long now please ensure it is resolved immediately. I am in no way a guilty party in this - this is YOUR responsibility and yours alone.

    Still no communication from either Redten or Clode for me :confused:

    Mind you, that may change when they try to withdraw their payment this month and come away empty-handed...... :rotfl:

    I got a Deadlock letter now.

    I can now take it to court.

    Everyone Ask for a deadlock letter!

    At least my dealings with them are over. Now use the courts.

    so can someone (at clode) explain to me why because i owe £17.10p more than nickem i have to pay back £137.10 more.

    dear all,
    just receive my letter from clode for there offer of termination £159.80. I have just phoned clode and told them this is not exceptable as the pc was free and to come back with another offer which is acceptable. They said the person who is dealing with "redten" will not be in while 4pm today and he will phone me back. will keep you posted.

    Received my letter today from clode. with there offer of £159.80 for final settellment . I spoken to clode this morning and told them this is not exceptable and told them to go back and have another look at this offer as i signed up for a free pc. The young lady said the person dealing with the redten accounts will not be in while 4pm and can she take my phone number and he will ring me back. will let you know how i get on.

    I have been following this thread for a while now, and thanks to everyone for some very interesting, useful and occasionally amusing posts.
    Now I'm joining in, so sorry but its a longish post.

    It seems to me that the only forward movement at the moment is through Clode, even though their offers are largely insulting and abysmal. NJP refuse to get involved and deadten appear to have left the planet.
    Unfortunately I am one of the idiots who paid for 3 years up front, so I cannot even negotiate with Clode as I have no involvement with them. This seems to leave me high and dry - no contact with deadten, no MAC and no way to even disconnect. Any suggestions would be gratefully received - I am sure there must be a number of fellow idiots in the same position. (BTW, I tried Sky and TalkTalk and both say they can do nothing without a MAC or disconnection). One question I would raise is if everyone is insisting only deadten can raise a MAC, how come Clode can promise to do so???
    One final note - as I reached 15Gb on 7th April without even knowing the limit existed till I got the email from NJP pretending to be deadten (they couldn't even get the phone number or the email address right!) I have been throttled to no more than 6KBs since then and still am in spite of getting into May now. So I'm totally stuffed, exasperated and at a loss how to get out of the appalling mess. Good luck to everyone who manages to escape! I hope you get your MACs - time will tell.
