You guys are right of course, I'm seriously thinking of withdrawing my counter offer and going all the way. Will wait and see what their tone is like when they respond but judging by previous correspondence I dont hold out much hope for them.0

Just got an email back from Consume Direct regarding my complaint. I've posted it below for the benfit of other Scottish customers as it may have some bearing on their case:
[SIZE=-0] "Based on the information given I would advise under the Supply of Goods and Services Act 1982 (as amended) and Common Law in Scotland any goods should be of a satisfactory quality and the service carried out with reasonable skill and care.
At this stage a recorded delivery letter should be sent to the trader stating the above and the reasons for the breach of contract.
Request a response within 14 days and send a copy to the finance company.

Just fired this email off to "The Judge" at the Sunday Mail.
Dear Judge,
In October 2006 I read a small article in the Daily Record concerning a new Internet company called Redten. According to the article, customers would be given a free personal computer system worth £500, a free upgrade to Windows Vista when it came on the market, free software every month. All of this in return for a three year contract of £19.99 per month for unlimited broadband provided by Redten. I investigated the story further online through various consumer websites and Redten’s own webpage which had a useful FAQ and copies of their terms and conditions. Satisfied, I signed up in November 2006 for a package costing £26.99 per month as I opted to also receive a multi function printer. Upon signing up I discovered that to receive my package I would have to sign a credit agreement with a company called Clode Retail Finance for the duration of the three year deal.
While I was able to switch my internet service almost immediately, my Computer did not arrive until January 2007. At first I thought it was faulty but upon opening the case I discovered that the hard drive was disconnected. I was supplied with a US format keyboard and only one of the two system restore disks arrived. My printer did not arrive. After a number of phone calls and emails I was eventually able to swap the keyboard, get the missing disk and get my printer by February. My free upgrade to Windows Vista sadly did not arrive due to a problem with the website of the company supposedly processing it, the deadline for redeeming the offer expired and Redten could offer me nothing but excuses. I put the experience behind me and by and large I have to say I was a happy customer. My internet connection was fairly stable and when I moved house in July 2007 I was able to transfer my account with no hassle.
On March 10th 2008 I logged on to my computer to find the following message:

Eventually by accessing the internet at work I discovered that Redten had chosen to migrate its services from BT Wholesale to a company called NJP. Apparently letters and emails had been sent to customers to explain this. I have not received either a letter or an email from Redten notifying me of this change. I attempted to email Redten only to find none of the addresses I had been provided appeared to produce a response. I called Redten only to find myself on hold for large periods of time with. I tried to contact Redten's Broadband support line (a premium rate 50p per minute line I might add) only for it to ring endlessly with no reply until eventually cutting off. I work as teacher and don't have the time to spend my life on hold. I tried phoning from home a still could not get through. I eventually, was able to get through to NJP and discovered that they had no record of my account and that no details had been passed on to them. They advised that I call Redten on the number I had been trying all week to advise them of my status. I continued to call Redten at various times of the day - from when they purportedly open to just before the office closes. Each time, despite spending an average of 30 minutes or so on hold I could find no-one to take my call.
Unable to resolve the situation I called BT Wholesale to procure a migration code and transferred my internet service to Tiscali. I next contacted Clode Retail Finance via email and recorded delivery ( I sent a copy to Redten also) to ask them to cancel my contract and my finance agreement as I believed them to be in breach of the Supply of Goods and Services Act 1982 (as amended) and Common Law in Scotland which holds that any goods should be of a satisfactory quality and the service carried out with reasonable skill and care. I also believe them to be in breach of the Consumer Credit Act. In response I got automated email replies and a letter from Clode which went to my old address and claimed that my service had been successfully transferred to NJP. After further phone calls and emails I received.
Yesterday Clode sent me a letter offering to let me buy myself out of my contract for a reduced sum claiming that:
“Under your agreement with us you have purchased both hardware equipment and broadband service over an agreed period however if you choose to take up the offer below the equipment will be yours to keep, the broadband service will be terminated and your account closed (and no further direct debits will be due).
Your current loan balance is £533.8 with 20 payments of £26.69 remaining due under the contract however we will accept a payment of £293.8 in full and final settlement of your account.
This equates to a rebate of £12 per month for the remainder of your contract term. In line with the current market this is sufficient to cover the cost of an alternative broadband product from a supplier of your choice.
If you do wish to accept this offer please contact our customer services on 0844 844 4700 prior to 2nd May 2008 to make a single payment by Debit Card. Please ensure you quote reference ‘Redten Offer’. Alternatively you can write to Customer Relations at the above address with a cheque for the settlement amount made payable to Clode Retail Finance.
I would stress that you are no obligation to take up this offer and if you choose not to do this the Redten will continue to provide your contracted service to the end of your contracted period and you will remain liable for the monthly loan repayments due to Clode under the existing finance agreement.
Please note that your finance agreement can only be cancelled by us and cannot be agreed with any other party including Redten Communications Ltd.”
When I contacted them to suggest that their offer was insulting and ignoring the fact that my service has never been resumed. I also pointed out that the hardware they referred to was “free” and posted them a copy of my invoice to prove it. I received a terse email: “We acknowledge that our offer has been declined and that you are still without any connection. We will continue to investigate this non-service with Red10 and will contact you again shortly.”
The situation is now beyond the joke. The situation is no nearer to being resolved and Clode continue to siphon £26.99 per month out of my bank account for a non existent internet service while I also have to pay Tiscali for one that does work. As far as I can see my only option now is to take them to court.

Phoned Clode today to accept offer - answered after a couple of rings and quickly passed through to someone who took my details - friendly and efficient. Promised Mac in a few days and would get another 12 days or so grace to find new supplier. All seemed very reasonable.
I received PC around 8th Nov 07 and broadband supply around 27th October -They say I've made 5 payments. I reckon its about 6½ months Broadband less the downtime in March - reasonably generous.
I feel sorry for those who are unable to get Broadband at low prices but if Clode are being reasonable I think they would be sympathetic if you can give them proof. The Samknows website lists all the exchanges and services listed available in your area. Keep the letter short and to the point, list services you can get and price and make it easy for them to check details so be honest!
Tell them that you would like the £12 allowance increased to this figure and give them a couple of weeks to respond. If they make you an offer too early then everyone here will find out and try for more spoiling the chances of other people in same position.
Remeber its Redten that have failed us - Clode are just picking up the tabs and won't be interested in oboslete computers. Its therefore in their intrests to sort this mess quickly and give Redten a "reasonable bill" for the shortfall.
As Redten is unlikely to pay Clode the name will change finally to Deadten!

Got my offer on 28th, joined November 2006, settlement figure £175.78.
But I wasn't transferred to NJP, now with sky. But Clode letter obviously not on a individual basis, as they should know who was or wasn't transferred.
Told them where to shove it & have already cancelled DD. I'm certainly not paying for a free computer.
A friend of mine who joined the same time has not had any offer by either email or snail mail. They have also cancelled their DD and were not transferred to NJP.0 -
If I were with another isp now as some of you are because of not being transfered or one reason or another I would take it all the way, but as I need a Mac Code and cannot receive one until the debt is payed off.... I feel I am caught between a rock and a hard place. This could drag on for months, my worry at the final outcome is to end up with unlimited again.... and be stuck with these clowns for the next two and a half years, I for one will not stay with this company at any cost.0
