    i was offline nearly two months last year try that for size and i let that go then as a well thats how it goes thing but my computer hasnt worked right since early last year as well never sent me what i asked for and if they charging me for supply of services ie internet and goods ie computer and other bits included in offer then clode owe me for a years worth of non working equipment two months of almost no internet plus this capped time and all the stuff i wasnt sent err to me it makes thier contract null and void even before this crap happened and for those with the nice more updated computer and less to pay off then just take your offers its ok for you lot you get all the benefits of us from day one who have paid more than you have all this time and still got to pay more than youve paid in total thats real good on us early sucrbibers clode get ya thinking caps on please your wrong in thinking its acceptable!!

    seems to me you have 3 choices.

    1/ accept the offer and get out now.
    2/ take clode to court.
    3/ accept what ever redten deem fit to give you till the end of contract.

    Guys,

    Just had a flick through all the posts after returning from work and feeling like a bit of a traitor but I phoned clode this morning while at work to pay the £31 settlement fee they have given me in the email. I am one of the lucky ones who was only paying 12.99 and to me £30 quid seems a small price to pay to be shot of this whole stressful and frustrating situation and to move onto a new provider.

    I agree with the comments regarding those earlier customers who have already paid xx amount of 19.99 or 24.99 into this for a longer period to now be hit with a larger settlement figure. Seems they have just done a blanket £12 rebate a month for all customers and luckily enough for me this left 0.99 totalled up for the remaining months to pay to get out, but I feel sorry for you guys who seem to be in the majority with your 100+ figures. I know I wouldnt be able to accept that even if I wanted to at such short notice from them.

    I have been assured that the contract is now at an end as the payment has gone through and that we have around a 2 week grace period where our internet will not be disconnected and mac code will be sent out shortly so unless something goes drastically wrong it looks like I have finally got an outcome to this whole sorry mess.

    Guys and gals you have been lifesavers at some points during these shananigans and think I would have gone off the rails without this thread's in-jokes, dry wit, cheap shots and of course benjimoron (maybe hes the new director!). I wish those of you who are still taking this further the best of luck fighting the good fight.

    P.S This probably isn't good bye as Ill be popping in and out to see how the whole story ends and it has become like a habit to check this on a daily/hourly/10-minutely basis one of which I believe it will be hard to break......I love you guys! :beer:

    I've had my offer - being one of the 'originals' from 2006, it's £190. I can't believe Clode think it is acceptable to offer all categories £12 a month rebate - to be honest, if I only had to pay £30 as some will, (ie if I was only paying £12.99 a month) I would take it, as others have said, just to be out of the whole sorry saga. I don't understand how Clode cannot see that the rest of us - who have been with them for so long - will feel aggrieved (to say the least) that we are being expected to cough up £200!!It's such a daft offer, I find it hard to believe that they thought it would be acceptable - unless they hope that most people who receive it don't come onto this forum and see what others have been offered.Once again - Clode not dealing with customer complaints as individuals, but taking the scattergun approach.
    I agree with an earlier post - Clode hope that enough people will go for this first offer, to try and weaken the position of the remainder....at least they will recoup some of their Redten money. But the fact is, those of us who signed up earliest, signed a contract for a free PC. If our broadband has been terminated then the contract has been broken with nothing owing.:mad:

    I had not missed that point, I also had a call from the trading standards today informing me that Luton Trading Standards could not track down |Redten beyond the accommodation address in London, could it be that Redten have actually ceased trading and that all the accounts have been transferred to NJP by Clode, who now want as many people to settle, before it becomes public knowledge and it is proven that Redten can not indeed fulfill their contractual obligations?
    I also received an email with the same derisory offer stated by Nicola Dobson but it was interesting to note, that they are only allowing 5 days before you are deemed to have accepted their new terms and conditions. It was also interesting to note that a new name was on the bottom, that of a Louise Hingley (Underwriter)

    The thick plottens further still, anybody fancy writing a who done it book? :rotfl:

    well ive refused the offer and do ont accept thier terms if refused to be kept into the contract im going to take it further now no choice but thinking about it they have given a good fight for a court they let people who got the same equipment go for peanuts a judge will shurley pick up on this point when it is brought to their attention and will with no doubt base thier judgement on such out comes !!!

    There is a fourth option and that is to make a counter offer for what you deem to be an acceptable figure.

    done that its in my email to them i did :) i gave them three choices and nothing can be more fair than that !!!!

    my three options of counter claim :)

    1.either collect the pc from me free of charge and reimburse me from 2006
    start of contract as is my right to ask for under the breach of contract and
    for the other issues i set out in my last recorded letter to you and redten
    and provide me with my mac code immidiatly.

    2.send me all items that are missing especially the missing restore disks as
    my computer will not funtion properly untill such time and redten were
    informed of this at the start of last year, the vista update a uk keyboard
    and a full explination on where warranty now lies and who with !!, an
    assurance that as contract that i get the upgrade free of charge to 24mgb
    line when exchanges are upgraded also the immediate return of my unlimited
    service with no caps and no changed fair usage policy containing any sort of
    capping or changes to the usage of that service and a reimbursement of time
    spent on limited service. and also the provision of a written document
    stating that such is going to be completed in no less than 5 working days .

    3.or failing either of the above 2 you release me from my contract without
    any further cost or penaltys or affecting my credit rating and provide me
    with a mac code with in the next 5 working days.

    There are a number of factually incorrect statements in the emails you've all been getting from Clode.

    1: None of you bought equipment from Redten - the equipment was free.

    2: They say that Redten can supply you with broadband, as per their contractual agreement. Yes, Redten can supply you with broadband, but not as per contract. The contract is for unlimited broadband with no restrictions. You're all capped at 15GBs now - that's in no way unlimited.

    3: They say they are offering you a way out by agreeing a sum for the remainder of the finance agreement minus the cost of broadband. The agreement you all have with Redten is for unlimited broadband and nothing else. If you accept the offer, you're effectively paying them for no reason at all, as you will no longer be supplied with broadband by Redten.


    The bottom line is this:

    Clode is trying to get back as much of its money as possible. They are trying to make people pay for the free PC/laptop, whilst allowing you all to cancel the broadband contract. Basically, Redten was paying for the equipment and the broadband with the money they got you all to borrow from Clode. However, they did not factor into their business plan the rising cost of broadband provision, and the fact that they would face competition (AOL giving away free laptops now without having to take out a finance agreement, and only a 2 year contract, for example). They were also not aware that the way backbone providers charge for broadband would change (now they charge for usage, rather than for the line). Due to a bad business model and lack of foresight, Redten has found it increasingly hard to pay its bills, hence being kicked off BT's backbone. I would advise no-one to accept this offer. I suggest writing back to Clode explaining the above. You don't owe them a penny for equipment, as it was free and Redten cannot provide you with unlimited broadband, as per their contractual agreement with you. As such, the only course of action is for a complete cancellation of the contract without financial penality.

    Don't trust them........experience should tell you this.

    For those who accept the invitation to settle.......just make sure you get it all in writing first.........clode are slippery toads you know :p
