If they do give you an unimited service, it will be subject to a Fair Usage Policy - but then that depends what they call fair. All they have to do is set the FUP to 15GB, and say that they are giving you 'unlimited' downloads.

You will not be getting a completly unlimited service, it just isn't viable.

They cannot get away with that as WE still have to agree to the NEW TERMS, they must give notice that they are changing conditions IN WRITING, this is where all this mess has come from, they didn't give us the required notice or the option of terminating our agreement if the new terms and conditions were to our detriment.

    Email to Clode:

    Dear Sir or Madam,

I understand that a £12 a month rebate is on offer. Does this mean I will get a refund of 24 x 12 = £288 and a broadband service, albeit restricted?

Please make the cheque payable to Mr

    Thanks

    Yours in hope,

i have not had any offer
i get my broadband from BT
i have stopped paying my DD
im going to charge them the £24.99 i am going to have to pay for unlimited for the next 20 months minus the £19.99 that would have gone to them had they provided a service
so i guess they will owe me £100
    i will accept cash only

    Yours in hope,

Yeah very good - I for one am going to take them up on their offer - get a new supplier and keep my laptop (at a bit of a reduced price) leaving my credit history nice and clean (my main worry in the current climate!).

I dont think its worthwhile winding them up or they will not budge at all and probobly not deal with you at all. Rembemer, Clode are the only folks that we have had any real communication with over the last 7 weeks.

I will put this whole sorry affair down to 'a too good to be true offer'

On another note - I hear that you can get free flghts when you buy a hoover...:rotfl:

    Hi FCI

Nice to see you around again, just pressed Nicola for my offer, and basically was told that it was the same as the other 20 monthers i.e. £12 reduction, just fired off a reply to the effect that I would rather stick red hot needles in my eyes and that the £7.50 payment on offer was an intrim payment for the reduced service I am currently receiving, until the matter is resolved, not an offer to continue for another 20 months with a company that cannot offer me what we contracted for.
I am suspending my direct debit from tomorrow and will pay the £7.50 by other means.
Will talk to my solicitor again tomorrow and see what he says.
Will be in touch by pm soon, they still will not give me a MAC code, pointed out to Nicola that they are now on working day 16 of the 5 working days allowed by law!!!

carefull JP --if you pay by other means they will charge you an additional 1.6% on each payment for the priviledge of paying them.

better either adjusting your DD but then why would you only pay half

their view will be that if you dont pay in full you're in default --so better paying full and claiming back through court or withold all when you lodge a court claim.

Alternatively deduct from any settlement figure etc etc.

they owe £100 plus the contract cancelled or 20 x 24.99 to cover cost of contract plus the addition.

I'm also tempted to take the offer as I just want out of this mess and go with a reliable ISP. Have not contemplated withholding payments as I believe this could very easily get you a black mark on you're credit record.
I regard the whole thing as a lesson learned ie: you get what you pay for.
The reduced settlement is some victory in itself as we would not have got this offer without the constant pressure we have put them under.
Good luck to all those who wish to persue it further but I think that a court case is you're only option now.

grg79679 You can get another free laptop from AOL if you're interested. :rotfl:
