    As discussed during our recent telephone call once we obtained clarity from customers as to whether they wish to take up the offer we will be looking to address the issues around unlimited download etc and we remain fully confident that all your concerns will be resolved at that point.

    I understand that your situation is slightly different as you have already moved away from Redten however we will be more than happy to arrange reconnection to the service.

    Alternatively we would be happy to consider any other proposal you may have to settle your account given the unique nature of your position.

    As previously advised we plan to address all customer concerns around ‘unlimited’ downloads once we have identified which customers wish to take up the offer however the simple answer to your question is - yes we can.

    We have discussed before the potential for illegal activity utilizing unlimited download offers however we are confident we can deal with this using the existing ‘fair usage policy’ within the existing terms and conditions however this will not affect the majority of customers.

    I've now asked if they can provide unlimited broadband with free upgrade to 24Mb then to do this within the next 5 days. failing that I hold them in breach of contract. They have made a detrimental change to my service and I therefore have the right to cancel.


  • Please no one rush into this. They havent given us enough time to think over this offer. 5 days is not enough. The email does mean that have accepted liability though.

    I wonder why they think £12 is enough to get unlimited broadband. I'm with BT and pay £24.99

    They Also forget the PC was "FREE" and a carrot on a stick. We are in a better position to take this further now.

    I agree they have done this so people will rush into this pay the final figure and run off. I for one am happy to help anyone out with the courts. Can we join together and make one big submission to the courts?

    My main concern is for those on benefits who cant afford to take the option of a settlement

    I have not received any offer via email or otherwise.

    As I cannot get alternative broadband for less than the 24.99 to BT then I am on the same position as you.
    Clode owe me £140 for the provision of alternative unlimited for the remainder of my contract. That is for the additional cost of provision over and above that of 19.99 per month.

    Therefore if they were to offer me similar to others it would not make financial sense for me to accept.

    However the emails they have sent do tend to highlight their liability and like you, they will make valuable evidence at a small claims court submission.

    I made them an offer on the 23.4.2008, which was that they ended the financial contract now with no financial liability to me or vice versa.

    If they force me to go to court to end it then I will seek that £140 in addition to the expenses and court costs etc. I have already outlined.

    You have the option of lodging a claim either through your residential county court or theirs.

    If a number of people in England lodge the same claim at the same time, it will automatically be lodged centrally by the courts into a group claim which will be cheaper than the normal £65.

    I will have to lodge it in scotland and it will be up to the sherrif court to decide if they pursue it here or look to combine with others in england. I suspect they will want to pursue it here as I have more rights here through common law which would be important if clode were silly enough to appeal to a higher court here ie the high court in Edinburgh. As it will cost upwards of £2000 just to lodge an appearance at the high court, even I do not think they will be so silly in repect of pursuing around £150. ( what they have offered to others, )

    I miscalculated the dates --my claim gets lodged on Thursday the 1.5.2008 as I gave them 5 working days to respond and the court would mark against me if I lodged in advance of that.

    I will be withholding my DD of 19.99 in lieu of the total debt of clode which is over £550; ie the cost of alternative provision of unlimited broadband for 21 months.

    Redten acknowledged they will not provide this which is why they closed my account and gave me a mac code.

    ***For the others on 12.99 per month who have been offered settlement of about £30.

    You must take legal advice on this--to ensure that all matters are included in the " Full "" calculation --and if so then you must give serious consideration to it as it would be 50% of what it would cost you to pursue what you are owed by clode.

    Anyone without access to their own lawyer can get free legal advice on this via a legal aid lawyer who will give the first consultation for free; usually half an hour or lthrough a local legal aid centre.

    In your case it would be nice to stand on principle but you also have to be pragmatic.


    At least Clode are beginning to see the light now.

    So, they could immediately provide us with unlimited broadband, as contracted, but are choosing not to?
  • I faxed my court documents to clode with a covering letter calling them the draft resolution. I was put through to nicola dobson without hassle. I also faxed the same documents the MD Nick davies.

    Nicola asked me how I got this figure. So I told her.

    I have also given them the option to settle finance agreement for £19.90, I got to this figure minus costs and the difference in broadband cost multiplied by my remaining term in months.

    £159.80 - Broadband difference £70

    Personal Costs £69.90

    MY settlement Figure £19.90

    well who are they going to use to provide this unlimited and also what are the fair usage policy terms they say they will run it under contain or whay version or even who`s version think they would have to be a bit more official than what they have offerd to people so far as in it should contain what they offer and what is inteneded as matter of law to what youd agree to buy out of or stay with it`s all a rouse to get people to pay what they can get back and then goodbye your not our problem no more (hehehehe muahahahaahahaaaaahaaaa suckers!!!)
