    your all missing another very important issue here at first they said it was redten who had to cancel the contract they couldnt do it so why the sudden change in saying only they can change it or cancel it now and not redten what is going on here ???

    Cheers - I might just do that - sell the redten one and keep the AOL one (better spec). Might even make a profit out of it!

    At least AOL shouldnt go under.

    Might have to get the sherrif court to do that --but then it will be for much more in my favour --just been adding up the costs I have incurred in this fiasco and al will be charged to Clode, who despite " working with and being close to redten " refused to answer letters and state what was really going on.

    There is no other supplier, the supplier is NJP who might be persuaded to give 30GBs but there is no unlimited as they stopped it for their own customers in feb 08.

    One way or another, I am not paying twice for the same internet supply.

    well got my offer after eventually getting a reply from nick davies earlier and it says i can get out for a measly 251.79 what ever i aint paying nothing thats not what i deserve i sent this as my reply !!!

    well i think that offer is not very well thought up after i have not
    recieved my upgrade to vista i have never recieved my uk keyboard or the
    disks to restore my computer so it works properly and has not funtioned
    properly since early last year and also it seems theres been no warranty on
    it since bizbone went out of buisiness last year as im aware so if you
    deduct the moneis spent of phoning you and redten for this hicup plus the a
    small compansation for the lack of paid for service since when it got
    changed over and the cost of letters and a small reimburstment for time and
    effort spent on a resolve im afraid I do ont accept this offer as i feel it
    is totally unfair and unjust to the problems i have faced throughout all
    this and the fact i have not recieved all i have been paying for since 2006
    you are obliged to reimburse me for these. this leaves me to make a counter
    offer of
    1.either collect the pc from me free of charge and reimburse me from 2006
    start of contract as is my right to ask for under the breach of contract and
    for the other issues i set out in my last recorded letter to you and redten
    and provide me with my mac code immidiatly.

    2.send me all items that are missing especially the missing restore disks as
    my computer will not funtion properly untill such time and redten were
    informed of this at the start of last year, the vista update a uk keyboard
    and a full explination on where warranty now lies and who with !!, an
    assurance that as contract that i get the upgrade free of charge to 24mgb
    line when exchanges are upgraded also the immediate return of my unlimited
    service with no caps and no changed fair usage policy containing any sort of
    capping or changes to the usage of that service and a reimbursement of time
    spent on limited service. and also the provision of a written document
    stating that such is going to be completed in no less than 5 working days .

    3.or failing either of the above 2 you release me from my contract without
    any further cost or penaltys or affecting my credit rating and provide me
    with a mac code with in the next 5 working days.

    I consider all three options to be fair and with in the law regarding my
    rights i did seek legal advice on these and all are seen as a reasonable
    offer from me considering the complexity of the matters and the said
    breaches and lack of the equipment and services being provided under the
    contract!!!.

    This is the mental part. I've only been with them since novmenber and all I have to pay is £185. I be my PC is newer and better than yours aswell.

    Tough luck mate! - this just aint fair on anybody!!!

    Stands to reason. You're finance contract is with Clode so only they can settle it. I never thought any different and would not have accepted any offer from redten to cancel.
    Asked clode about mac code and they said should get one within 7 days of cancellation and that the connection would last for a grace period of 2 weeks from cancellation.

    Ok Maco,

    They seem to be making this offer following discussions with redten, that would proboly justify why they are offering it. I think its good to at least have some progress with the situation - and at least something we can go back to Clode with and discuss.

    Personally I think Im going to go for the deal - I am worried that if I dont, Redten will go bust and I will be left with a Tag on my line and thus no broadband for a very long time. The whole non-contact thing with redten is VERY suss.

    The fact that Baber Gulzar quit last week is also another alarm bell.

    I have been offline for nearly two weeks now with noone to conact to complain to / ask to fix it. This is intollerable and as such I will pay and leave.

    You cant really set up a class action at county court level--the court itself does this when it sees a number of claims coming in at the same time with the same breach of S of G/S and CCA against a single retailer or company eg clode.

    The claims, though lodged at different courts round the country are all centered in the north jurisdiction and pursued as one issue. English law and for all english and welsh claimants. The single lodgement costs are reduced in direct relation to the number of claims lodged.

    Not really the road for any claimant who has been offered a full and final settlement of all liabilities of less than £30. Unless of course they have paid up front and not received equipment to which they were entitled --they are fully entitled to a complete refund of all monies, in the same manner as was charged originally.
