I had not missed that point, I also had a call from the trading standards today informing me that Luton Trading Standards could not track down |Redten beyond the accommodation address in London, could it be that Redten have actually ceased trading and that all the accounts have been transferred to NJP by Clode, who now want as many people to settle, before it becomes public knowledge and it is proven that Redten can not indeed fulfill their contractual obligations?
I also received an email with the same derisory offer stated by Nicola Dobson but it was interesting to note, that they are only allowing 5 days before you are deemed to have accepted their new terms and conditions. It was also interesting to note that a new name was on the bottom, that of a Louise Hingley (Underwriter)
The thick plottens further still, anybody fancy writing a who done it book? :rotfl:
Must be their insurers, who willl have worked out the legal costs of defending claims vis a vis the offers and if people accept then the amount to be paid by the insurers is lessened. For the insurers, the costs of defending the small claims will in the main be greater than the value of the small claim of around £100/150. Most legal practitioners charge a very minimum of £200 per hour.
However they may not have realised, though cannot believe that, but the actual entitlement in law is the return of the monies already paid as well as the remaining amount plus expenses where and when services fail to be provided.
Of course they may be hoping that if enough people jump ship now they may be left with a diehard small group which they will then perhaps purchase the services for from some other provider such as BE. Trouble is they wont know how much that will cost until they
1. see how many leave
2. see what it will cost for the remainder which might actually be higher than they think because I suspect that many of us come from areas where the cheap offers do not apply as we are outwith the networked areas and thats one of the reasons we went with redten in the first place, because it was on BTs network.
3, while virgins 50Mbps broadband speed is just round the corner for some. 60% of the country are still not covered by competing providers because of the lack of networked exchanges.
4 see where the claims have to be defended, eg aberdeen for one poster --cost of one average overnight hotel up there more than the outstanding account.
5 Clode is a business not a benefactor and will always opt for the cheapest option.

that i mentioned ages ago about that it is on the goods act i did try to get everyones attention to that exact point well early on that from break of contract we keep the goods and they must pay us back every penny all ready paid to them from day one thats every one should be going for if they dont want the easy option of just cancelling our contracts and letting us go no penaltys or further costs or bad rating its what the law states well my offer is more than fair to them let me go ill forget the compansation and the monies spent all ready on the contract to me thats sense they still get to keep my money from when the contract started !!!0 -

Consumer Credit Act 1974 (CCA74)Section 75 of the Consumer Credit Act 1974 states that the lender of money for a purchase is jointly responsible with the seller for the purchaser getting the goods or service purchased, or receiving a full refund if they do not receive the goods or service. What this means in practice is that if you paid more than £100 by a UK issued personal credit card (but not a debit or charge card), or borrowed money under a loan agreement regulated by the CCA74 and arranged by the trader, then you can claim ALL the money you paid (irrespective of how you paid it) provided that the maximum contract value does not exceed £30,000, back from the card company or lender if you do not get what you bought.
I did receive the goods and services until the BT Walled Garden event.
and I think these days the courts will only look at your actual loss which in my case would be loss of unlimited service from that eventWho cares ??0 -
Got the following message today after my last email. Guess I'll see them in court!
Morning Mr *********
We acknowledge that our offer has been declined and that you are still without any connection. We will continue to investigate this non-service with Red10 and will contact you again shortly.

Mr ***********
I note that you have now declined this offer.
As discussed during our recent telephone call once we obtained clarity from customers as to whether they wish to take up the offer we will be looking to address the issues around unlimited download etc and we remain fully confident that all your concerns will be resolved at that point.
I understand that your situation is slightly different as you have already moved away from Redten however we will be more than happy to arrange reconnection to the service.
Alternatively we would be happy to consider any other proposal you may have to settle your account given the unique nature of your position.
Regards
Nick

Looks to me like FCI says, they are waiting to see how many are left after the offer to see what it's going to cost them, either in court fees, or to pay another supplier to give unlimited. I've pushed and pushed for them to give details of what the unlimited service will be, as I told them how could anyone make a decision with no information regarding the alternative.

Can somebody please read my original message and point out the part where I told them I was declining their offer?0

Erm, I can't see it. Perhaps they didn't read it properly - now that would be a surprise!Beware the character seeking personal gain masquerading as a moral crusader.

cant beleive people are still worried about this just dont give clode any more money there is no way they are going to persue anyone and there is more chance of me getting my wicked way with jordon than clode having the cheek to turn up at court when clode stop getting paid they will soon take the hint and cut off the service then you can move to a new provider0
